SUB-SUBLEASES Sample Clauses

The SUB-SUBLEASES clause governs the conditions under which a tenant who is already subleasing a property may further sublease all or part of the premises to another party. Typically, this clause outlines the requirements for obtaining the landlord’s consent, any limitations on the duration or terms of such sub-subleases, and the responsibilities of the original tenant in relation to the new sub-subtenant. SUB-SUBLEASES. (1) The Borough, at its discretion, may consent to a sub-sublease if: (a) In the Borough's reasonable opinion, the proposed sub-sublease is in the best interest of the Airport's operation; (b) The Sublessee sub-subleases the space for an amount not exceeding the rent the Borough charges for that space plus the Sublessee's maintenance and operation costs, an allowance for amortization of the Sublessee's improvements and a fifteen percent (15%) administrative charge; (c) The term of any sub-sublease does not extend beyond the expiration of the term of this Sublease; and (d) The Borough has no comparable vacant space available for the proposed sub- sublease. (2) Consent to a sub-sublease by the Borough does not relieve or otherwise alter the obligations of the Sublessee under this Sublease.
SUB-SUBLEASES. The City and RIDA agree that no sub-sub-sublease of the Site and no sub-sublease of the Improvements (each, a “Sub-sublease”) shall be made except as set forth in this Article 10.
SUB-SUBLEASES. Except for the Permitted Sub-Subleases, Seller shall not enter into any New Sub-Sublease or modify or terminate any then-existing Sub-Sublease or apply any security deposit or grant any consent or waiver relating to any Subtenant under a Sub-Sublease without the prior consent of Purchaser; provided, that if Seller is not permitted to unreasonably withhold, condition or delay its consent or waiver under the terms of such Sub-Sublease, then Purchaser’s consent under this Section 8.4 shall not be unreasonably withheld, conditioned or delayed. If Purchaser fails to notify Seller in writing of Purchaser’s objections within five (5) Business Days of Purchaser’s receipt of the proposed modification, termination or new lease terms (and a request for Purchaser’s approval), then Purchaser will be deemed to have disapproved the same. In addition to the foregoing, Seller may not consent to any assignment of, or subletting under, any Sub-Sublease (except that Purchaser’s prior consent will not be required to the extent that, under the terms of the applicable Sub-Sublease or applicable Law, Seller is obligated to consent to the proposed assignment or subletting) without the prior consent of Purchaser. Seller shall comply in all material respects with the Sub-Subleases.
SUB-SUBLEASES. The parties specifically recognize and agree that if any sub- sublease or sub-sub-sublease of the Real Property (hereinafter, a “Sub-sublease”) shall terminate for any reason, other than the successful enforcement of the right of reverter by the Florida Department of Transportation pursuant to the Public Purpose Quit Claim Deed or DT’s or BankUnited’s failure to cure, within any applicable cure periods under the Master Lease or this Agreement, any violations of Sections 3 or 27 of the Master Lease or Section 16 hereof requiring use of the Real Property for purposes consistent with Section 159.101 - 7095, Florida Statutes, as amended from time to time; then DT (if the First Tier Sublease, but not the Master Lease has been terminated), so long as such default causing the termination of the Master Lease or First Tier Sublease, as the case may be, is cured by the Authority (if the First Tier Sublease but not the Master Lease has been terminated) or the City (if the Master Lease has been terminated) shall enter into a new lease of the Real Property with the first mortgagee of the Sub-sublessee’s interest, if any, on the same terms and conditions set forth in the Sub-sublease, provided same is consistent with the Master Lease, so long as any default under the applicable Sub-sublease (to the extent within the reasonable control of such Mortgagee) is timely cured as otherwise provided in such Sub- sublease. Notice of any termination shall be given to the Sub-sublessee in accordance with the requirements of its Sub-sublease.

  • Subleases (a) Promptly, but in any event within five (5) Business Days, following the execution and delivery of any sublease permitted by this Article XXV, Lessee shall notify Lessor of the execution of such sublease. As of the date of each Lease Supplement, Lessee shall lease the respective Property described in such Lease Supplement from Lessor, and any existing tenant respecting such Property shall automatically be deemed to be a subtenant of Lessee and not a tenant of Lessor. (b) Without the prior written consent of the Agent, any Lender, any Holder or Lessor and subject to the other provisions of this Section 25.2, Lessee may sublet any Property or portion thereof so long as such sublease (i) is on market terms, (ii) does not extend beyond (A) the Basic Term Expiration Date (if such sublease is in force during the Basic Term) and (B) the expiration date of any then applicable Renewal Term (if such sublease is in force during such Renewal Term) and (iii) is expressly subject and subordinate to this Lease. Except as referenced in the immediately preceding sentence, no other subleases shall be permitted unless consented to in writing by Lessor. All subleasing shall be done on market terms and shall in no way diminish the fair market value or useful life of any applicable Property. (c) No sublease (referenced in this Section 25.2 or otherwise) or other relinquishment of possession to any Property shall in any way discharge or diminish any of Lessee’s obligations to Lessor hereunder and Lessee shall remain directly and primarily liable under this Lease as to such Property, or portion thereof, so sublet.
