Common use of Structural Defects Clause in Contracts

Structural Defects. 10.1 The Landlord shall be responsible to make good and repair any structural defect in the Demised Premises by reason of a pre-existing condition in or damage done to the Building in which the Demised Premises are located, or damage caused by negligence of the Landlord, its servants or agents. 10.2 The Landlord shall cause proper maintenance of all Common Areas, at the Tenant's cost to the extent of the Tenant's Proportionate Share.
