Common use of Statutory Terms Clause in Contracts

Statutory Terms. The University and ABCTB acknowledge that if, under applicable State, Territory or Commonwealth law, the Recipient is a consumer: (a) certain warranties or conditions may be implied in this agreement; or (b) certain guarantees may be conferred on the Recipient and certain rights may be conferred on the Recipient, which cannot be excluded, restricted or modified. If so, and if that law applies to the University and ABCTB, then to the maximum extent permitted by law, the University’s and ABTCB’s liability is limited, at the University’s and ABCTB’s option, to resupply of the relevant goods or the payment of the cost of resupplying the relevant goods.
