(d) Where time off is to be scheduled it shall occur at a time mutually agreed between the Employer and the employee. 10.04 When a holiday designated in Article 10.01 occurs on a day scheduled as a day off for a full time Employee, the employee may receive pay for the holiday when mutually agreed between the Employer and the Employee or shall be scheduled for an alternate day off with pay in lieu of the holiday at a time mutually agreed. 10.05 If any Employee is not scheduled to work a Holiday and is called in to work without seventy-two (72) hours notice for a shift commencing on the calendar date of a Holiday, the Employee shall be paid two (2 x) times the Employee’s regular rate of pay for hours worked that shift. In addition, the Full-Time Employee shall receive an alternate seven and one-half (7.5) hour day off in lieu of the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employee. 10.06 The Employer will schedule Employees required to work holidays on a fair and equitable basis. An Employee shall have either Christmas Eve and Christmas Day or New Year’s Eve and New Year's Day off, on a yearly rotating basis unless mutually agreed otherwise. This provision is not applicable to a Casual Employee. Shifts commencing at 3:00 pm or later on Christmas Eve or New Year’s Eve will be recognized as working Christmas or New Year’s for the purpose of affecting a yearly rotating basis. 10.07 Employees who are scheduled for work and report for duty on December 24th and are required to work beyond 12:00 noon shall be compensated for all hours worked after 12:00 noon, to a maximum of four (4) hours at the rate of one and one half (1.5x) times the Employees regular hourly rate of pay. 10.08 Employees required to work beyond the seven and one half (7.5) hours shift hours for a shift commencing on the calendar date of a Holiday shall receive compensation at the rate of two (2 x) times the Employee’s regular hourly rate of pay for all hours worked beyond the shift. 10.09 Employees shall be eligible for compensation under this Article only for the regular shifts where the majority of shift hours occur on the calendar date of a Holiday 10.10 If one or more holidays noted in Article 10.01 occurs during the regular scheduled vacation of a Regular Employee, the Full-Time Employee shall receive holiday pay for that day. STATUTORY HOLIDAYS. 9(1) All members of the Department shall, subject to Section 9(2) below be entitled to the following holidays: New Year's Day, Good Friday, Easter Monday, Victoria Day, Canada Day, British Columbia Day, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day, Boxing Day, and all general holidays proclaimed, declared or otherwise designated by the City of Victoria, the Province of British Columbia and/or the Government of Canada.
9(2) The following shall apply to any member who works on any of the holidays mentioned in Section 9(1) above:
(a) compensation in pay shall be made at the rate of time and one-half (1½x) in addition to regular pay; and,
(b) a member covered by Section 11(1) shall also receive a day off in lieu, for each one (1) of the holidays worked.
9(3) The following shall apply to those members working the ten (10) and twelve (12) hour shift:
(a) they shall be granted eighty-eight (88) hours up-front statutory leave for each calendar year;
(b) this time shall be expended in time off and it may be taken in a block;
(c) members who have previously designated blocks of statutory leave shall be given consideration where later, minimum leave is stipulated during the block;
(d) a statutory holiday shall be considered as being the date upon which the shift commences.
9(4) Any member who is on annual leave, weekly leave or receiving Workers' Compensation benefits on the date that a statutory holiday occurs, shall be entitled to time off or pay in lieu of such holiday, except members covered by Article 11, Sections (2) and (3) to whom this Section 9(4) shall apply only in respect to workers' compensation benefits.
(a) Members not working on a statutory holiday who do not receive up-front statutory holiday time shall be deducted in the amount of the number of hours by which his normal daily shift hours exceed eight (8).
(b) Members not working on a statutory holiday who receive up-front statutory holiday time shall be deducted in the amount of the number of hours equal to his normal daily shift hours.
(c) Deductions referred to above shall be mutually arranged between the member and the Chief Constable.
9(6) The following shall apply to the Patrol Division:

(b) In addition Any such reduction of manpower shall first be determined on a voluntary basis and to the above holidaysextent that insufficient members volunteer to take the statutory holiday off, any the Chief Constable or his shift supervisor may designate such additional holidays declared by the Federal or Provincial governmentsnumber of members as may be required.
(c) The parties recognize the significance Board shall endeavour to ensure an equitable distribution of ▇▇▇▇▇ Day and an Employee who requests the day of June 11th off in accordance with Article 9.05(b), the Employer will schedule the Employee accordingly. ▇▇▇▇▇ Day is not a recognized paid holiday and premium pay for that day will not apply.
10.02 Compensation for statutory holidays will be the Employee’s regular classification rate except where the Employee has been temporarily assigned to a classification paying a higher rate whereby they would receive the higher classification rate.

10.05 If any Employee is not scheduled to work a Holiday and on such statutory holiday but is called in ordered to work without seventy-two (72) hours notice for a shift commencing on take the calendar date of a Holiday, the Employee shall be paid two (2 x) times the Employee’s regular rate of pay for hours worked that shift. In addition, the Full-Time Employee shall receive an alternate seven and one-half (7.5) hour day off in lieu of accordance with the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employee.
10.06 The Employer will schedule Employees required to work holidays on a fair and equitable basis. An Employee above, shall receive his normal salary but shall have either Christmas Eve and Christmas Day or New Year’s Eve and New Year's Day off, on a yearly rotating basis unless mutually agreed otherwise. This provision is not applicable his advanced statutory holiday time reduced by eight (8) hours pursuant to a Casual Employee. Shifts commencing at 3:00 pm or later on Christmas Eve or New Year’s Eve will be recognized as working Christmas or New Year’s for the purpose of affecting a yearly rotating basisSection 9(5) above.
10.07 Employees who are scheduled for work and report for duty on December 24th and are required to work beyond 12:00 noon shall be compensated for all hours worked after 12:00 noon, to a maximum of four (4) hours at the rate of one and one half (1.5x) times the Employees regular hourly rate of pay.

10.02 Compensation for statutory holidays working on a holiday, an employee must have been on the payroll at least thirty (30) calendar days in advance of the holiday. An eligible employee who has worked at least fifteen (15) of the thirty (30) calendar days prior to the holiday is entitled to pro-rated holiday pay. An eligible employee who has worked fewer than fifteen (15) of the thirty (30) calendar days prior to the holiday is entitled to pro-rated holiday pay. If an eligible employee works on a general holiday, then payment will be the Employee’s regular classification rate except where the Employee has been temporarily assigned to a classification paying a higher rate whereby they would receive the higher classification rate.
(a) If an employee works a shift on the calendar date of a holiday listed in Article 10.01, the employee will be compensated at the rate of one one-and one-half (1.5x1-1/2X) times normal rates. In addition, a day off with pay at a mutually agreed date will be accorded that employee. Where a general holiday falls during an employee's vacation or on a normal day of rest, then another day off with pay at a mutually agreed date will be accorded that employee. Vacation and paid sick time shall be considered time worked. By the employee’s regular hourly rate for 's choice and by mutual agreement of the Employer, statutory holidays may be scheduled in the week prior to or the week following the one in which the statutory holiday occurs. For the purpose of Statutory Holidays: Commencing with their fifth (5th) week of employment, full-time employees shall receive forty (40) hours workedpay at straight time rates and shall work four (4) days, thirty-two (32) hours, including work on the statutory holiday, in a week in which one (1) statutory holiday occurs; three (3) days, twenty-four (24) hours, including work on the statutory holiday, in a week in which two (2) statutory holidays occur. The method Time worked in excess of compensation forty (40) hours of actual work by part-time employees during a week in which a statutory holiday or statutory holidays occur shall be pay or paid at the rate of time off to be determined by the Employee.

This Marginal Paragraph applies only to be determined time worked on the day designated by the EmployeeCompany as the statutory holiday.
13.03 Employees who do not work on a statutory holiday will receive normal pay subject to the following terms and conditions:
(i) An employee who has been assigned to work on a statutory holiday and does not work shall not receive any pay for the holiday.
(bii) In addition An employee who is absent without leave on the last work day immediately preceding the statutory holiday or the first work day immediately following the statutory holiday according to the compensation work schedule to which he is assigned, shall not receive any payment for the hours worked on the holiday the Regular Full-Time employee shall have the option to have seven and one half (7.5) hours as pay or time off as mutually agreed between the Employer and the employeestatutory holiday.
(ciii) In lieu of If a statutory holiday occurs during the holidays listed employee’s vacation as provided in Article 10.01 aboveArticles 14 or 15 and if the employee would normally have been paid for the statutory holiday had he not been on vacation, Regular Part-Time employees such employee shall be entitled to one (1) hour given an additional day of holiday compensation vacation with pay for each 23.5 regular hours paid. The method of compensation shall be pay or time off as determined by mutual agreementsuch statutory holiday occurring during the vacation.
(div) Where time The named statutory holidays will be observed in the following manner: For those employees working on the Teck Metals Ltd. continuous operations schedules the holidays will be observed on the dates on which the holidays fall. If a statutory holiday falls on an employee’s day of rest, the employee shall receive an additional day off is to be scheduled it shall occur with pay at a time mutually agreed upon between the Employer Company and the employee. If no mutually suitable day has been agreed upon within ninety (90) days of such holiday, the Company shall designate such day. The New Year’s holiday shall be deemed to commence on night shift on December 31 and for purposes of statutory holiday pay would continue for the next twenty-four (24) hours. For all other employees, when any such holiday falls on a Saturday or Sunday, the Monday immediately following shall be considered as the holiday. When Christmas Day falls on a Saturday or Sunday, the Monday immediately following will be considered to be the holiday for Christmas Day and the Tuesday immediately following will be considered to be the holiday for Boxing Day.
10.04 When a holiday designated in Article 10.01 occurs on a (v) Sections (i), (iii) and (iv) will not apply to the floating statutory holidays. The floating statutory holidays may be taken at any time convenient to the Operation.
(vi) Notwithstanding any other provisions of this Agreement an employee or group of employees and the Company may agree to change the shift or shifts of such employee or group of employees or the day scheduled to be considered as a day off for a full time Employee, the statutory holiday. No employee may receive pay for the holiday when mutually agreed between the Employer and the Employee or shall be scheduled compelled to exchange shifts or the date of statutory holidays by the Company. No overtime rates shall be payable for an alternate day off with pay in lieu of the holiday at a time mutually agreed.
10.05 If any Employee is not scheduled to work a Holiday and is called in to work without seventy-two (72) hours notice for reason where a shift commencing on exchange is requested by an employee, or where the calendar date of a Holidaystatutory holiday is changed, for work performed on the Employee shall day previously considered as the statutory holiday. The Union agrees that it will not oppose a Company request to exchange shifts or the days on which statutory holidays are to be paid two (2 x) times observed where there is no hardship or loss imposed on the Employee’s regular rate of pay for hours worked that shiftemployees and all the employees involved consent to such exchanges. In addition, the Full-Time Employee shall receive an alternate seven and one-half (7.5) hour day off in lieu The Union will be provided with copies of the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employeeshift exchange slips.

The method of compensation or who have completed thirty (30) working days with the Company in the preceding twelve (12) months shall be entitled to receive such statutory holidays as are set forth in the current Employment Standards Code, or as follows (whichever is more favourable), provided they meet the terms and conditions set out in this section:
i) New Year's Day
ii) Alberta Family Day
iii) Good Friday
iv) Victoria Day
v) Canada Day (July 01)
vi) Labour Day
vii) Thanksgiving Day
viii) Remembrance Day and
ix) Christmas Day
c) Part-time employees shall be entitled to statutory holidays commensurate with their status as temporary, provisional, probationary or permanent. Statutory holiday pay or time off shall be paid on a bi-weekly basis as determined by mutual agreementa premium calculated at four point six percent (4.6%) of normal bi-weekly earnings.
(d) All employees shall receive the recognized statutory holidays for which they are eligible, with pay, or other days with pay in lieu of such statutory holiday, or pay in lieu, provided they are available for work in accordance with their shift preceding, during and following the designated day for observance of the holiday, or on approved leave for a period of ten (10) working days or less duration, except when such leave is a result of a compensable accident. Where time off is to be scheduled it shall occur at a time mutually agreed between the Employer and the employee.
10.04 When a holiday designated in Article 10.01 occurs on Company designates a day scheduled as a day off in lieu of the actual statutory holiday for a full time Employeethe majority of its employees, the employee may be allowed off on such day. In the event that the Company requires the employee to work, the employee may be allowed a day off in lieu of the statutory holiday at a time that is mutually agreeable to the employee and the supervisor. If such a day cannot be provided, the employee shall receive a day's pay in lieu of the statutory holiday.
e) The statutory holidays shall be observed by the parties to this Agreement on the normal calendar day of occurrence. Employees shall be eligible for the premium pay provisions of 6.06 on the normal calendar day only. It is expressly agreed and understood that the normal calendar day shall be observed as the statutory holiday in lieu of any alternative day which may be established by legislation and that the statutory holiday provisions shall not apply under any circumstances to any alternative calendar day which may be established by legislation. Where the Company designates a day in lieu of the actual statutory holiday for the majority of its employees and an employee is assigned such day off with pay and because of conditions of the service he is required to report to work, he shall receive the off day premium as provided in 6.05 unless he has received seven (7) calendar days notice of such change.

f) A day’s pay for the a statutory holiday when mutually agreed between the Employer and the Employee or shall be scheduled for an alternate a day off with pay in lieu of the a statutory holiday at a time mutually agreed.
10.05 If any Employee is not scheduled to work a Holiday and is called in to work without seventy-two (72) hours notice for a shift commencing on the calendar date of a Holiday, the Employee shall be paid two equal to the monetary or time equivalent of eight (2 x) times 8) hours work, except that in the Employee’s regular rate case of pay for hours worked that shift. In addition, the Full-Time Employee shall receive an alternate seven and one-half (7.5) hour day off in lieu of the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employee.
10.06 The Employer will schedule Employees required to work holidays on a fair and equitable basis. An Employee shall have either Christmas Eve and Christmas Day or New Year’s Eve and New Year's Day off, on a yearly rotating basis unless mutually agreed otherwise. This provision is not applicable to a Casual Employee. Shifts commencing at 3:00 pm or later on Christmas Eve or New Year’s Eve will be recognized as working Christmas or New Year’s for the purpose of affecting a yearly rotating basis.
10.07 Employees employees who are scheduled for working in accordance with an approved compressed work and report for duty on December 24th and are required to work beyond 12:00 noon shall be compensated for all hours worked after 12:00 noonweek program, to a maximum of four (4) hours at the rate of one and one half (1.5x) times the Employees regular hourly rate of pay.
10.08 Employees required to work beyond the seven and one half (7.5) hours shift hours for a shift commencing on the calendar date of a Holiday shall receive compensation at the rate of two (2 x) times the Employee’s regular hourly rate of pay for all hours worked beyond the shift.
10.09 Employees shall be eligible for compensation under this Article only for the regular shifts where the majority of shift hours occur on shifts worked in the calendar date of a Holiday
10.10 If one or more holidays noted in Article 10.01 occurs during the regular scheduled vacation of a Regular Employeepay period are longer than eight (8) hours, the Full-Time Employee shall receive holiday pay for that day. The Part-time employee shall receive pay for that day will be paid a monetary amount equal to the extent that they have banked holiday credits. In both cases, vacation credits shall not be reduced for that day. This provision is not applicable to a Casual Employeelength of the majority of working shifts in the pay period.

STATUTORY HOLIDAYS. 33.01 Subject to Article 33.03:

(a) (ii) When a statutory holiday falls within an employee works a shift on the calendar date of a holiday listed in Article 10.01, the employee will employee’s annual vacation an alternate day shall be compensated at the rate of one and one-half (1.5x) times granted to the employee’s regular hourly rate for the hours worked. (b) In addition Full-time employees may choose to have their lieu time paid out or may choose to accumulate lieu time up to the compensation for end of the hours worked on the holiday the Regular Full-Time employee shall have the option calendar year. 33.03 In order to be entitled to paid statutory holiday pay, an employee must have worked all of his/her last regularly scheduled shift before the statutory holiday compensation for each 23.5 regular hours paid. The method and all of compensation shall be pay or time off his/her regularly scheduled shift following the statutory holiday unless the absence is as determined by mutual agreementa result of reasonable cause.

10.02 Compensation for statutory holidays When an employee is required to work on a Statutory Holiday because their shift falls on a Statutory Holiday the employee will be paid three (3) times their regular daily rate of pay. The rate is based on the Employee’s pro rata basis as stated in Appendix "A" (Monthly Pay Rates) except as otherwise provided under this article. For employees on a twelve (12) hour rotating shift that work on a Statutory Holidays, they shall be paid double time for all hours of their shift that fall on that calendar day, in addition to their regular classification rate except where the Employee has been temporarily assigned to a classification paying a higher rate whereby they would receive the higher classification rateStatutory Holiday pay as outlined in 10.01.

The additional day off will be the first scheduled working day after the vacation. The employee shall inform the foreperson of his/her choice at the time of arranging vacation as per Section 9. Employees who have worked a minimum of 100 shifts in the 12 months previous to December shall qualify for one (1) paid floating day to be taken in the holiday when following 12 months. Employees who have also reached twelve (12) years of unbroken service shall be entitled to one (1) additional paid floating day per year. Such day(s) will be in lieu of a regularly scheduled shift(s) and will be taken at a time to be mutually agreed between the Employer and the Employee or shall be scheduled for an alternate day off with pay in lieu of the holiday at a time mutually agreed.

10.10 If one or more holidays noted in Article 10.01 occurs during the regular scheduled vacation of a Regular Employee, the Full-Time Employee shall receive holiday pay for that day. The Part-time employee shall receive pay for that day to the extent that they have banked holiday credits. In both cases, vacation credits shall not be reduced for that day. This provision is not applicable to a Casual Employee.

STATUTORY HOLIDAYS.
9(1) All members of the Department shall, subject to Section 9(2) below be entitled to the following holidays: New Year's Day, Good Friday, Easter Monday, Victoria Day, Canada Day, British Columbia Day, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day, Boxing Day, and all general holidays proclaimed, declared or otherwise designated by the City of Victoria, the Province of British Columbia and/or the Government of Canada.
9(2) The following shall apply to any member who works on any of the holidays mentioned in Section 9(1) above:
(a) compensation in pay shall be made at the rate of time and one-half (1½x) in addition to regular pay; and,
(b) a member covered by Section 11(1) shall also receive a day off in lieu, for each one (1) of the holidays worked.
9(3) The following shall apply to those members working the ten (10) and twelve (12) hour shift:
(a) they shall be granted eighty-eight (88) hours up-front statutory leave for each calendar year;
(b) this time shall be expended in time off and it may be taken in a block;
(c) members who have previously designated blocks of statutory leave shall be given consideration where later, minimum leave is stipulated during the block;
(d) a statutory holiday shall be considered as being the date upon which the shift commences.
9(4) Any member who is on annual leave, weekly leave or receiving workers' compensation benefits on the date that a statutory holiday occurs, shall be entitled to time off or pay in lieu of such holiday, except members covered by Article 11, Sections (2) and (3) to whom this Section 9(4) shall apply only in respect to workers' compensation benefits.
(a) Members not working on a statutory holiday who do not receive up-front statutory holiday time shall be deducted in the amount of the number of hours by which his normal daily shift hours exceed eight (8).
(b) Members not working on a statutory holiday who receive up-front statutory holiday time shall be deducted in the amount of the number of hours equal to his normal daily shift hours.
(c) Deductions referred to above shall be mutually arranged between the member and the Chief Constable.
9(6) The following shall apply to the Patrol Division:
(a) The following eleven (11) calendar dates shall be recognized as paid (7.5 hours) holidays for full time employees:
1. New Year's Day 7. Labour Day
2. Good Friday 8. Thanksgiving Day
3. Easter Monday 9. Remembrance Day
4. Victoria Day 10. Christmas Day

(b) In addition Any such reduction of manpower shall first be determined on a voluntary basis and to the above holidaysextent that insufficient members volunteer to take the statutory holiday off, any the Chief Constable or his shift supervisor may designate such additional holidays declared by the Federal or Provincial governmentsnumber of members as may be required.
(c) The parties recognize the significance Board shall endeavour to ensure an equitable distribution of ▇▇▇▇▇ Day and an Employee who requests the day of June 11th off in accordance with Article 9.05(b), the Employer will schedule the Employee accordingly. ▇▇▇▇▇ Day is not a recognized paid holiday and premium pay for that day will not apply.
10.02 Compensation for statutory holidays will be the Employee’s regular classification rate except where the Employee has been temporarily assigned to a classification paying a higher rate whereby they would receive the higher classification rate.
(a) If an employee works a shift on the calendar date of a holiday listed in Article 10.01, the employee will be compensated at the rate of one and one-half (1.5x) times the employee’s regular hourly rate for the hours worked. The method of compensation shall be pay or enforced time off to be determined by the Employee.
(b) In addition to the compensation for the hours worked on the holiday the Regular Full-Time employee shall have the option to have seven and one half (7.5) hours as pay or time off as mutually agreed between the Employer and the employee.
(c) In lieu of the holidays listed in Article 10.01 above, Regular Part-Time employees shall be entitled to one (1) hour of holiday compensation for each 23.5 regular hours paid. The method of compensation shall be pay or time off as determined by mutual agreementstatutory holidays.
(d) Where time off is to A member who would ordinarily be scheduled it shall occur at a time mutually agreed between the Employer and the employee.
10.04 When a holiday designated in Article 10.01 occurs on a day scheduled as a day off for a full time Employee, the employee may receive pay for the holiday when mutually agreed between the Employer and the Employee or shall be scheduled for an alternate day off with pay in lieu of the holiday at a time mutually agreed.
10.05 If any Employee is not scheduled to work a Holiday and on such statutory holiday but is called in ordered to work without seventy-two (72) hours notice for a shift commencing on take the calendar date of a Holiday, the Employee shall be paid two (2 x) times the Employee’s regular rate of pay for hours worked that shift. In addition, the Full-Time Employee shall receive an alternate seven and one-half (7.5) hour day off in lieu of accordance with the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employee.
10.06 The Employer will schedule Employees required to work holidays on a fair and equitable basis. An Employee above, shall receive his normal salary but shall have either Christmas Eve and Christmas Day or New Year’s Eve and New Year's Day off, on a yearly rotating basis unless mutually agreed otherwise. This provision is not applicable his advanced statutory holiday time reduced by eight (8) hours pursuant to a Casual Employee. Shifts commencing at 3:00 pm or later on Christmas Eve or New Year’s Eve will be recognized as working Christmas or New Year’s for the purpose of affecting a yearly rotating basisSection 9(5) above.

10.08 Employees required to 6.03 When two (2) holidays, as listed, are observed in any week, employees will work beyond a three (3) day week and shall receive five (5) days’ pay at the seven standard rate. An employee who works on a fourth or fifth day in a week during which two (2) holidays, as listed, are observed, shall receive one and one half (7.5) hours shift hours for a shift commencing on the calendar date of a Holiday shall receive compensation at the rate of two (2 x1½) times the Employee’s his regular hourly rate for all hours so worked on the fourth and fifth day.
6.04 To qualify for pay, the employee must work his last scheduled working day preceding the holiday and his first scheduled working after the holiday unless he has secured permission from his Employer or his designate to be absent on one of the qualifying days. Employees who are off on compensation, accident or illness shall receive legal holiday pay if they have worked within fifteen (15) days of the holiday. They shall receive the difference between the legal holiday pay and what they otherwise receive from the Insurance Employer and/or Workers’ Compensation. Should a legal holiday occur within an employee’s leave of absence, he shall not be paid for such a legal holiday.
6.05 An employee required to work on any of the aforementioned holidays shall receive one and one half (1½) times his regular hourly rate for all hours worked beyond the shiftand shall, in addition, receive five (5) days’ for working a four (4) day week as outlined in paragraph 6.02.

13.03 Compensation for a holiday falling on a day of rest shall be as follows:
(a) When a calendar day designated as a holiday under Clause 13.01 coincides with a Ferry Captain’s day of rest, that employee shall receive one (1) day’s pay at his straight time rate to compensate for the holiday. The number of hours pay for this day shall correspond with the hours of work for the applicable holiday as contained in the established daily sailing schedule of the respective service.
(b) When a holiday falls on a Ferry Captain’s day of rest and that employee agrees or is required to work on such a holiday, he shall receive two (2) hours pay for each hour day worked on that day, in addition to his holiday pay. The employee may request time off in lieu of the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employee.
10.06 The Employer will schedule Employees required to work holidays on a fair and equitable basis. An Employee shall have either Christmas Eve and Christmas Day or New Year’s Eve and New Year's Day off, on a yearly rotating basis unless mutually agreed otherwise. 6. A pro-rated percentage of 96 hours, calculated on the ratio that the regularly scheduled hours of work bear to full time employment, will be credited to the bank on January 1st Monday in Augusteach calendar year.
(b) In addition If a regular part-time member works a regularly scheduled shift on a statutory holiday the regular part-time member shall be credited with one half of the total number of hours worked to the above holidays, any additional holidays declared by the Federal or Provincial governmentsregular part-time member's statutory holiday bank.
(c) The parties recognize the significance of ▇▇▇▇▇ Day and an Employee who requests the day of June 11th off in accordance with Article 9.05(bOne (1), the Employer will schedule the Employee accordingly. ▇▇▇▇▇ Day is not a recognized paid holiday and premium pay for that day will not apply.
10.02 Compensation for statutory holidays will be the Employee’s regular classification rate except where the Employee has been temporarily assigned to a classification paying a higher rate whereby they would receive the higher classification rate.

An Employee shall have either Christmas Eve and Christmas Day or New Year’s Eve and New Year's Day off, on a yearly rotating basis unless mutually agreed otherwise. This provision is not applicable to a Casual Employee. Shifts commencing at 3:00 pm or later on Christmas Eve or New Year’s Eve will be recognized as working Christmas or New Year’s for the purpose of affecting a yearly rotating basis.
10.07 Employees who are scheduled for work and report for duty on December 24th and are required to work beyond 12:00 noon shall be compensated for all hours worked after 12:00 noon, to a maximum of four (4) hours at the rate of one and one half (1.5x) times the Employees regular hourly rate of paycomputed therein.
10.08 Employees required to work beyond the seven and one half (7.5) hours shift hours for a shift commencing on the calendar date of a Holiday shall receive compensation at the rate of two (2 x) times the Employee’s regular hourly rate of pay for all hours worked beyond the shift.
10.09 Employees shall be eligible for compensation under this Article only for the regular shifts where the majority of shift hours occur on the calendar date of a Holiday
10.10 If one or more holidays noted in Article 10.01 occurs during the regular scheduled vacation of a Regular Employee, the Full-Time Employee shall receive holiday pay for that day. The Part-time employee shall receive pay for that day to the extent that they have banked holiday credits. In both cases, vacation credits shall not be reduced for that day. This provision is not applicable to a Casual Employee.

22.04 Members working the holiday shift system as set out in Article 4, will receive twelve (12) days or eighty-four (84) hours holidays in lieu of statutory holidays. Five (5) days or thirty-five (35) hours to be given in the form of pay on the 1st of December, or on the regular pay date preceding December 1st. Seven (7) days or forty-nine (49) hours will be taken in a block of twenty-seven (27), thirty-six (36) or forty-nine (49) hours. The remaining time, if any, will be taken as casual time off during the year. This time off must be submitted on a Special Request Form to their Supervisor who shall make a determination within three (3) working days.
22.05 In each year in lieu of taking the thirty-five (35) hours referred to in Article 22.04, a Member may take those hours as an additional vacation or casual time off, provided the Member so requests in writing and provided the request is authorized by the Chief of Police. Casual time off for this purpose shall not be less than two (2) hours. Members determining whether to be paid or take statutory holidays off after November 1st shall submit the request on or before October 15 th on a Special Request Form and their Supervisor shall make his or her determination within three (3) working days.
22.06 Members, excluding Civilian Court Staff, working the straight Monday to Friday day shift may request in writing to be granted time off in lieu of Heritage Day, Easter Monday or Remembrance Day. Casual time will be granted in lieu of one or more of these days, at a time mutually agreed.

6:03 An employee will be paid for a holiday provided the employee works the employees last full scheduled shift before and the employees first full scheduled shift after such holiday, and works on such holiday if the employee is scheduled to work unless the employee is excused by the Company. Permission will not be unreasonably withheld.
6:04 With the exception of the Drivers, a holiday for which an employee receives holiday pay shall be counted as pay a day worked for the purposes of computing overtime when an employee actually works on the sixth and/or seventh day in the week in which the holiday occurs.
6:05 When one or more plant holidays fall during an employee's week of vacation, the employee may reschedule one or more days vacation at a time off as mutually agreed between convenient to the Employer Company and the employee.

(ii) If a maximum part time employee is normally scheduled to work on any of the above holidays he/she shall be paid for his normal hours. In the event that he/she is required to work he/she shall be paid at the rate of time and one-half (1½). Note: Normally scheduled means that he/she has been scheduled to work on the day for the four (4) preceding weeks.
13:03 An employee will not be paid for the above holidays unless he/she works his scheduled working day before and his scheduled working day after the holiday unless the absence is due to illness or other emergency reasons.
13:04 A probationary employee will receive the above holiday entitlement subject to the provisions of Employment Standards Act.
13:05 Holiday pay will be paid on the following basis:
(i) Full time commissioned employees based on eight (8) hours at the rate of one and one half regular hourly pay plus eight (1.5x) 8) times the Employees previous four (4) worked weeks total commission divided by the previous four (4) worked weeks’ total hours.
(ii) Part time commissioned employees based on average hours worked at regular hourly rate of pay based on previous four (4) weeks plus average hours as previously calculated times the previous four (4) weeks total commission divided by the previous four (4) week’s total hours.
(iii) Full time non-commissioned employees based on eight (8) hours regular hourly pay.
10.08 Employees required to work beyond (iv) Part time non-commissioned employees based on average hours worked in the seven and one half previous four (7.54) hours shift hours for a shift commencing on the calendar date of a Holiday shall receive compensation weeks at the rate of two (2 x) times the Employee’s their regular hourly rate of pay for all hours worked beyond the shiftrate.

20.0.6 Leave for religious holidays or ceremonial events may be taken as paid personal leave days in accordance with Article 35.2 or granted without pay according to the approval provisions of Article 36.
20.0.7 To be eligible for statutory holiday benefits, an employee must be actively at work or on an approved leave on their last scheduled working day preceding and their first scheduled working day following the statutory holiday as observed by the University.
20.0.8 Employees shall be paid at one and one‐half (1.5) times their regular rate for all hours worked on the Statutory Holiday plus;
a) one (1) day’s pay at their regular rate of pay; or
b) at the employee’s request, an additional day off with pay at their regular rate of pay at a time mutually agreed.
10.05 If any Employee is agreeable to the employee and the appropriate OOS Manager. In additionday off or during his vacation period, the Full-Time employee will receive an additional day off or payment of holiday in lieu of the day off, but the additional day shall not be added to the period of vacation of the employee unless with the consent of the Head of the Department.
21.04 To qualify for payment of statutory holidays, the employee must work his or her regular scheduled shift immediately preceding and succeeding the holiday unless absent by reason of legitimate illness confirmed by medical certificate, if requested, and such illness commenced within thirty (30) days prior to the date of the statutory holiday.
21.05 Where an Employee is required to work authorized overtime in excess of his regularly scheduled hours on a paid holiday (but not including hours on a subsequent regularly scheduled shift) such employee shall receive an alternate seven two and one-half (7.52 ½) hour day off in lieu of the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employeetimes his regular straight time hourly rate for such additional authorized overtime.

6. 1st Monday 11.2 Residents who are scheduled to, and do work (for in-house or out-of-house call) on a statutory holiday or any portion thereof shall be entitled, in August
(b) In addition to their regular day’s pay to: • payment at the above holidays, any additional holidays declared by rate of one-half (1/2) times the Federal or Provincial governments.
(c) The parties recognize the significance of ▇▇▇▇▇ Day and an Employee who requests the normal day’s pay plus a paid day of June 11th off in accordance with Article 9.05(b), the Employer will schedule the Employee accordingly. ▇▇▇▇▇ Day is not a recognized paid holiday and premium pay for that day will not apply.
10.02 Compensation for statutory holidays will be the Employee’s regular classification rate except where the Employee has been temporarily assigned to a classification paying a higher rate whereby they would receive the higher classification rate.
(a) If an employee works a shift on the calendar date of a holiday listed in Article 10.01, the employee will be compensated • payment at the rate of one and one-half (1.5x1 1/2) times the employeenormal day’s regular hourly rate pay with no paid day off, subject to the mutual agreement between the Resident and Program Director • this benefit will be prorated on the basis of an eight (8) hour day if a resident is on call for the less than eight (8) hours worked. The method of compensation shall be pay or on a statutory holiday
11.3 Requests for paid time off in lieu of being on duty the day of the statutory holiday must: • be submitted to the College of Medicine within a thirty (30) day period before or after the day of the statutory holiday • be determined by shown explicitly on the Employeeduty schedule within the academic year wherever possible, or up to 60 days into the new academic year for returning residents.
(b) In addition to 11.4 For the compensation for the hours worked on the holiday the Regular Full-Time employee shall have the option to have seven and one half (7.5) hours as purpose of pay or time off as mutually agreed between the Employer and the employee.

11.5 Premium pay for being on duty the day of a statutory holiday compensation for each 23.5 regular hours paid. 11.6 If a statutory holiday falls on a Resident’s regularly scheduled day off or time during the vacation period, such Resident shall receive an additional day off with pay. Such day off shall be shown explicitly on the duty schedule.
11.7 Subject to patient care requirements as determined by mutual agreement.

10.05 If any Employee is not scheduled to work a Holiday and is called in to work without seventy-two off contiguous with the six (726) hours notice for a shift commencing on the calendar date of a Holiday, the Employee days shall be paid two at the discretion of the College of Medicine. Residents who are post call on their first of six (2 x6) times the Employee’s regular rate of pay for hours worked that shift. In addition, the Full-Time Employee shall consecutive calendar days off will receive an alternate seven additional day in lieu, provided they were receiving only six (6) consecutive days off. It is agreed and one-half understood that this provision takes advantage of the traditional seasonal slowdown in health services to afford Residents with a period of rest and reflection away from their regular duties between December 20 and January 5. The Employer will attempt to accommodate the interests of Residents in the observation of their religious holidays. Accommodation of religious holidays which are in addition to the holidays provided for in the Collective Agreement will be taken as Vacation Leave (7.5) hour Article 12.0), day off in lieu of statutory holiday worked (Article 11.2), Family or Personal Responsibility Leave (Article 13.8). There shall be no additional payment or time off for Residents who have worked on any statutory holiday between December 20 and January 5, provided they have received their six (6) day block as described above. The parties recognize that this provision represents a special situation and that regular work week and weekend is to be maintained in the Holiday at duty schedule prior to and/or after the six (6) day block. Residents and Program Directors will mutually determine the necessary adjustments to duty schedules to implement this clause in a mutually agreed time. This provision manner consistent with Article 9.
11.8 On-Call Duty on the Middle Day of a Long Weekend Where a Resident is not applicable scheduled for the middle day(s) of a long weekend, this person is entitled to a Casual Employee.

The Resident shall be compensated for all hours worked after 12:00 noon, entitled to claim only one (1) benefit in a maximum of twenty-four (424) hours at the rate of one and one half (1.5x) times the Employees regular hourly rate of payhour period.
10.08 Employees required to work beyond the seven and one half (7.5) hours shift hours for a shift commencing on the calendar date of a Holiday shall receive compensation at the rate of two (2 x) times the Employee’s regular hourly rate of pay for all hours worked beyond the shift.
10.09 Employees shall be eligible for compensation under this Article only for the regular shifts where the majority of shift hours occur on the calendar date of a Holiday
10.10 If one or more holidays noted in Article 10.01 occurs during the regular scheduled vacation of a Regular Employee, the Full-Time Employee shall receive holiday pay for that day. The Part-time employee shall receive pay for that day to the extent that they have banked holiday credits. In both cases, vacation credits shall not be reduced for that day. This provision is not applicable to a Casual Employee.

If an employee transfers by posting from one classification to another, it may affect whether they can be scheduled on an alternating basis in the first year. If the Christmas/New Year schedule has been posted, no employee already scheduled will be displaced from the schedule. The scheduling rules in this Agreement will not apply over the Christmas/New Year period if the effect of the rules is to prevent the Christmas and New Year’s scheduling (December 15 to January 5 as per above). Once the Christmas Schedule is prepared, The Employer can offer then available vacation opportunities in the Christmas period (December 15 to January 5) by seniority). Full-Time Employee shall receive holiday pay for that daytime employees may request prior to the Christmas, New Year’s schedule(s) whether they wish to work their regular shifts or count the Statutory Holidays as days worked, subject to management approval. The Part-time employee Christmas/New Year scheduling list will be posted from October 15 -31 each year, allowing employees to indicate their preference to be scheduled off and to be scheduled on. The Employer will take this list into consideration when scheduling the Christmas/New Year schedule. The Float Holiday shall receive pay for that day to be taken on Christmas Eve Day or the extent that they have banked holiday credits. In both cases, vacation credits shall not Day before New Year’s Day in accordance with the individual employee’s schedule.

10.02 Compensation be more than one hundred percent (100%) of his or her normal daily pay. Commencing with the fifth (5th) week of employment, an Employee will receive the following statutory holiday pay depending on the average hours he or she has worked in the four (4) weeks preceding the week in which the holiday occurs: For an Employeewho works five (5) eight (8) hour days: Worked Entitlement but less than or more pay for each holiday pay for each holiday For an Employeewho works four (4) ten hour days: Worked Entitlement but less than pay for each holiday or more pay for each holiday An Employee who has worked less than the average hours shown above will receive four (4) hours' pay for each statutory holiday, provided he or she has worked at least fifteen (15) days during the thirty (30) calendar days prior to the statutory holiday. For purposes of determining statutory holiday pay entitlement for a full-time Employee, all paid time off and hours absent due to sickness or accident, will be counted as hours worked if the full-time Employee would have been scheduled to work during the hours he or she were absent. An Employeewho works on a statutory holidaywill be paid at two (2) times his or her regular hourly rate of pay, and where so entitled, will also receive pay for the statutory holiday. An Employee in the Shipping Department who works on the statutory holidays listed below and starts at will be the Employee’s regular classification rate except where the Employee has been temporarily assigned to a classification paying a higher rate whereby they would receive the higher classification rate.
(a) If an employee works a shift on the calendar date of a holiday listed in Article 10.01, the employee will be compensated at the rate of one and one-half times his or her regular rate of pay until a.m. Any time worked before will be paid at two (1.5x2) times the employee’s his or her regular hourly rate for the hours worked. (c) In lieu of the holidays listed in Article 10.01 above, Regular Part-Time employees shall be entitled to one (1) hour of holiday compensation for each 23.5 regular hours paid. The method of compensation shall be pay or time off as determined by mutual agreement.

10.08 Employees 6.05 An employee who is required to work beyond on a given Statutory Holiday shall have the seven right to take another day off that week, separate and one half (7.5) hours shift hours apart from the Statutory Holiday.
6.06 To qualify for pay for a shift commencing on the calendar date of a Holiday shall receive compensation at the rate of two (2 x) times the Employee’s regular hourly rate of pay for all hours worked beyond the shift.
10.09 Employees shall be eligible for compensation under this Article only for the regular shifts where the majority of shift hours occur on the calendar date of a Statutory Holiday
10.10 If one or more holidays noted in Article 10.01 occurs during the regular scheduled vacation of a Regular Employee, the Full-Time Employee shall receive employee must have worked his last scheduled working day preceding the holiday pay for that dayand his first scheduled working day after the holiday, unless he has secured permission from his Supervisor to be absent on one of the qualifying days. The Part-time employee shall receive pay for that day An exception to the extent that they have banked above will be in the event an employee is absent the day before or the day after the statutory holiday creditscoincident with the beginning or end of an absence due to compensation, accident or illness, or leave of absence. 10.02 Compensation for statutory holidays will be the Employee’s regular classification rate except where the Employee has been temporarily assigned to a classification paying a higher rate whereby they would receive the higher classification rate.
(a) If an employee works a shift on the calendar date of a holiday listed in Article 10.01annual vacation period, the employee will be compensated at the rate of shall receive an additional day or days off.
11.04 Employees required to work their scheduled statutory holiday off shall receive one and one-half (1.5x1 ½ x) times the employee’s their regular hourly rate of pay for the hours worked, in addition to the pay they would otherwise receive for the statutory holiday. Any hours worked shall be rescheduled as time off in lieu with pay or banked as per Article 6.07.
(a) Each employee shall have two (2) days off with pay at their discretion and choice per year. The method Employer may limit such days with pay to one employee from each of compensation the Saskatoon or ▇▇▇▇▇▇ offices on any given day. During an employee’s first (calendar)
(b) Each employee shall be entitled to take their birthday off with pay and can schedule the day off to coincide with the weekend immediately prior to, or after the actual date of the birthday.
(c) In addition, one office per year will be closed between Boxing Day and New Year’s Day on an alternating basis, beginning with the ▇▇▇▇▇▇ office in 2000. Such time off shall be with pay. If required by the Employer, Accounting staff may be excepted from the closing during this period, but will be entitled to take off an equal amount of time during the year.
(d) When an employee’s unpaid day of rest falls on a day within the period of any paid Christmas closure, such employee shall be entitled to take an additional vacation day in lieu to be determined by scheduled at a mutually agreeable time between December 1 and December 21 of the Employeecalendar year in which the unpaid day of rest falls.
(a) When a statutory holiday falls on a part-time employee’s regular day of work, the employee shall receive their regular rate for that day.
(b) In addition to the compensation for the hours worked on the case of casual employees or when a statutory holiday the Regular Full-Time employee shall have the option to have seven and one half (7.5) hours as pay or time off as mutually agreed between the Employer and the employee.
(c) In lieu of the holidays listed in Article 10.01 above, Regular Part-Time employees shall be entitled to one (1) hour of holiday compensation for each 23.5 regular hours paid. The method of compensation shall be pay or time off as determined by mutual agreement.
(d) Where time off is to be scheduled it shall occur at a time mutually agreed between the Employer and the employee.
10.04 When a holiday designated in Article 10.01 occurs falls on a part-time employee’s regular scheduled day scheduled as a day off for a full time Employeeoff, the that employee may receive pay for the holiday when mutually agreed between the Employer and the Employee or shall be scheduled for an alternate day off with pay in lieu of the holiday at a time mutually agreed.
10.05 If any Employee is not scheduled to work a Holiday and is called in to work without seventy-two (72) hours notice for a shift commencing on the calendar date of a Holiday, the Employee shall be paid two the greater of three different calculations:
(2 xi) times the Employee’s regular rate of pay for Total hours worked that shift. In addition, the Full-Time Employee shall receive an alternate seven and one-half (7.5) hour day off in lieu of the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employee.
10.06 The Employer will schedule Employees required to work holidays on a fair and equitable basis. An Employee shall have either Christmas Eve and Christmas Day or New Year’s Eve and New Year's Day off, on a yearly rotating basis unless mutually agreed otherwise. This provision is not applicable to a Casual Employee. Shifts commencing at 3:00 pm or later on Christmas Eve or New Year’s Eve will be recognized as working Christmas or New Year’s for the purpose of affecting a yearly rotating basis.
10.07 Employees who are scheduled for work and report for duty on December 24th and are required to work beyond 12:00 noon shall be compensated for all hours worked after 12:00 noon, to a maximum of previous four (4) weeks divided by twenty, or;
(ii) Total hours at the rate in previous twelve (12) months divided by 1820, or;
(iii) Average daily wage, exclusive of one and one half (1.5x) times the Employees regular hourly rate of pay.
10.08 Employees required to work beyond the seven and one half (7.5) hours shift hours for a shift commencing on the calendar date of a Holiday shall receive compensation at the rate of two (2 x) times the Employee’s regular hourly rate of pay for all hours worked beyond the shift.
10.09 Employees shall be eligible for compensation under this Article only overtime, for the regular shifts where four (4) immediately preceding days during which they worked that bear the majority of shift hours occur same name as the day on which the calendar date of a Holiday
10.10 If one or more holidays noted in Article 10.01 occurs during the regular scheduled vacation of a Regular Employee, the Full-Time Employee shall receive public holiday pay for that day. If the Employer opens its stores on November 11th, each employee hired prior to July 5, 2012 will be given a float holiday as a statutory holiday on a day mutually agreed to during the month of November. Failing agreement, management shall schedule the floater in conjunction with an employee’s 's regular day off. For the purpose of this clause, senior employees will have preference in scheduling.
6.02 In order for an employee, full-time or part-time, to receive Statutory Holiday pay, he must:
1. not have been voluntarily absent from work on the scheduled work day prior to and following such holiday;
2. have worked his full regular designated weekly hours for the week in which holidays, a holiday or portion of a holiday occur, except for bonafide illness.
6.03 All part-time employees who have been employed thirty (30) calendar days or more and have worked an average of at least thirty-two (32) hours or more per week in the four (4) weeks preceding the week in which a statutory holiday occurs, shall receive eight (8) hours pay at his or her regular hourly rate for each holiday.
6.04 All part-time employees who have been employed thirty (30) calendar days or more and have worked an average of at least twenty (20) hours work, but less than thirty-two (32) hours per week in the four (4) weeks preceding the week in which a statutory holiday occurs, shall receive six (6) hours worked. pay at his or her regular hourly rate for each holiday.
6.05 All part-time employees who have been employed thirty (30) calendar days or more and have worked an average of at least ten (10) hours a week, but less than twenty (20) hours per week in the four (4) weeks preceding the week in which a statutory holiday occurs, shall receive three (3) hours pay at his regular hourly rate for each holiday.
6.06 The method of compensation shall be pay or time off Employer may designate the Good Friday general holiday to be determined observed in the following week for those employees who volunteer to do so provided it gives the Union fourteen (14) days advance notice. In situations where there are more volunteers in a department who wish to observe Good Friday in the following week than are needed by the Employee.
(b) In addition Employer, the senior employee will be given preference subject to the compensation for Employer having sufficient qualified employees on duty to efficiently operate the hours worked on business. For those full-time employees who observe Good Friday in the holiday following week they will be given either the Regular Full-Time employee shall have Monday or Saturday as their day off in the option to have seven and one half (7.5) hours as pay or time off as week following Good Friday, unless mutually agreed to between the Employer and the employee.
(c) In lieu of the holidays listed in Article 10.01 above, Regular Part-Time employees shall be entitled to one (1) hour of holiday compensation for each 23.5 regular hours paid. The method of compensation shall be pay or time off as determined by mutual agreement.
(d) Where time off is to be scheduled it shall occur at a time mutually agreed between the Employer and the employee.
10.04 When a holiday designated in Article 10.01 occurs Work performed on a day scheduled as a day off for a full time Employee, the employee may receive pay for the holiday when mutually agreed between the Employer and the Employee or shall be scheduled for an alternate day off with pay in lieu of the holiday at a time mutually agreed.

10.05 If any Employee is not scheduled to work a Holiday and is called in to work without seventy-two (72) hours notice for a shift commencing on the calendar date of a Holiday, the Employee shall be paid two (2 x) times the Employee’s their regular rate of pay for hours worked that shift. In additionpay, such day to be determined by mutual agreement between the Full-Time Employee shall receive an alternate seven and one-half (7.5) hour day off in lieu his Supervisor but not later than the conclusion of the Holiday at a mutually agreed time. In all departments where a holiday falls on an employee’s regular hourly rate for regularly assigned day of rest and he/she does not work on such day of rest, any other day as agreed upon between the hours workedCo-operative and the employee shall be observed as the paid holiday. The method of compensation shall be pay or time off to be determined by Co-operative and the Employee.
(b) In addition to the compensation for the hours worked employee must agree on the holiday day or week the Regular Full-Time employee shall have the option to have seven and one half (7.5holiday(s) hours as pay or time off as mutually agreed between the Employer and the employee.

When a any holiday designated or holidays as set out in Section 1 of this Article 10.01 occurs on a day scheduled as a day off for a full time Employeefall in an employee's work week, the employee may receive pay for the holiday when mutually agreed between the Employer and the Employee or work week shall be reduced by one day or the number of hours scheduled to be worked in that day for an alternate all employees (if a one day off with holiday occurs) and by two (2) days or the number of hours scheduled to be worked on those two (2) days for all employees (if a two day holiday occurs). No employee shall suffer a reduction in take-home pay in lieu such a week but shall receive his/her full week's pay. Employees working in excess of the holiday at reduced hours of work in such a time mutually agreed.
10.05 If any Employee is not scheduled to work a Holiday and is called in to work without seventy-two (72) hours notice for a shift commencing on the calendar date of a Holiday, the Employee week shall be paid two (2 x) times the Employee’s paid, in addition to their regular rate of pay for hours worked that shift. In additionsuch a week, the Full-Time Employee shall receive an alternate seven one and one-half (7.51 1/2) hour day off in lieu of the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employee.

(b) In addition to the compensation for the hours worked on the holiday the Regular Full-Time employee shall have the option to have seven and one half (7.5) hours as pay or time off as mutually agreed between the Employer and the employee.
(c) In lieu of the holidays listed in Article 10.01 above, Regular Part-Time employees shall be entitled to one (1) hour of holiday compensation for each 23.5 regular hours paid. The method of compensation shall be pay or time off as determined by mutual agreement.
(d) Where time off is to be scheduled it shall occur at given a time mutually agreed between the Employer and the employee.
10.04 When a holiday designated in Article 10.01 occurs on a day scheduled as a day off for a full time Employee, the employee may receive pay for the holiday when mutually agreed between the Employer and the Employee or shall be scheduled for an alternate day off with pay in lieu of such holiday.
22.04 Members working the holiday shift system as set out in Article 4, will receive twelve (12) days or eighty-four (84) hours holidays in lieu of statutory holidays. Five (5) days or thirty-five (35) hours to be given in the form of pay on the 1st of December, or on the regular pay date preceding December 1st. Seven (7) days or forty-nine (49) hours will be taken in a block of twenty-seven (27), thirty-six (36) or forty-nine (49) hours. The remaining time, if any, will be taken as casual time off during the year. This time off must be submitted on a Special Request Form to their Supervisor who shall make a determination within three (3) working days.
22.05 In each year in lieu of taking the thirty-five (35) hours referred to in Article 22.04, a Member may take those hours as an additional vacation or casual time off, provided the Member so requests in writing and provided the request is authorized by the Chief of Police. Casual time off for this purpose shall not be less than two (2) hours. Members determining whether to be paid or take statutory holidays off after November 1st shall submit the request on or before October 15th on a Special Request Form and their Supervisor shall make his or her determination within three (3) working days.
22.06 Members, excluding Civilian Court Staff, working the straight Monday to Friday day shift may request in writing to be granted time off in lieu of Heritage Day, Easter Monday or Remembrance Day. Casual time will be granted in lieu of one or more of these days, at a time mutually agreed.
10.05 If any Employee is not scheduled to work a Holiday agreeable between the supervisor and is called in to work without seventy-two (72) hours notice the Member. Casual time for a shift commencing on the calendar date of a Holiday, the Employee shall be paid two (2 x) times the Employee’s regular rate of pay for hours worked that shift. In addition, the Full-Time Employee shall receive an alternate seven and one-half (7.5) hour day off in lieu of the Holiday at a mutually agreed time. This provision is not applicable to a Casual Employee.
10.06 The Employer will schedule Employees required to work holidays on a fair and equitable basis. An Employee shall have either Christmas Eve and Christmas Day or New Year’s Eve and New Year's Day off, on a yearly rotating basis unless mutually agreed otherwise. This provision is not applicable to a Casual Employee. Shifts commencing at 3:00 pm or later on Christmas Eve or New Year’s Eve will be recognized as working Christmas or New Year’s for the this purpose of affecting a yearly rotating basis.
10.07 Employees who are scheduled for work and report for duty on December 24th and are required to work beyond 12:00 noon shall be compensated for all hours worked after 12:00 noon, to a maximum of four (4) hours at the rate of one and one half (1.5x) times the Employees regular hourly rate of pay.
10.08 Employees required to work beyond the seven and one half (7.5) hours shift hours for a shift commencing on the calendar date of a Holiday shall receive compensation at the rate of two (2 x) times the Employee’s regular hourly rate of pay for all hours worked beyond the shift.
10.09 Employees shall be eligible for compensation under this Article only for the regular shifts where the majority of shift hours occur on the calendar date of a Holiday
10.10 If one or more holidays noted in Article 10.01 occurs during the regular scheduled vacation of a Regular Employee, the Full-Time Employee shall receive holiday pay for that day. The Part-time employee shall receive pay for that day to the extent that they have banked holiday credits. In both cases, vacation credits shall not be reduced for less than two (2) hours. STATUTORY HOLIDAYS. (a) The following eleven (11) calendar dates An employee shall be recognized as paid (7.5 hours) holidays for full time employees:
1. New Year's Day 7. Labour Day
2. Good Friday 8. Thanksgiving Day
3. Easter Monday 9. Remembrance Day
4. Victoria Day 10. Christmas Day
5. Canada Day 11. Boxing Day
6. 1st Monday in August
(b) In addition to the above holidays, any additional holidays declared by the Federal or Provincial governments.
(c) The parties recognize the significance of ▇▇▇▇▇ Day and an Employee who requests the day of June 11th off in accordance with Article 9.05(b), the Employer will schedule the Employee accordingly. ▇▇▇▇▇ Day is not a recognized paid holiday and premium receive regular shift pay for that day will not apply.
10.02 Compensation for statutory holidays will be the Employee’s at their regular classification rate except where the Employee has been temporarily assigned to a classification paying a higher rate whereby they would receive the higher classification rate.
(a) If an employee works a shift on the calendar date of a holiday listed in Article 10.01, the employee will be compensated at the rate of one and one-half (1.5x) times the employee’s regular hourly rate for the hours worked. The method of compensation shall be pay or time off following holidays: New Year’s Day Labour Day Good Friday Thanksgiving Day Victoria Day Christmas Day Canada Day Boxing Day Civic Holiday Family Day Two (2) floating days to be determined by the Employee.

10.07 Employees who are scheduled for work and report for duty on December 24th and are required to work beyond 12:00 noon shall be compensated for all hours worked after 12:00 noon, to a maximum of four (4) hours paid at the rate of one and one half (1.5x1 ½) times his/her regular rate for the Employees hours worked, plus his/her regular hourly full shift at his/her regular straight time rate as a Holiday pay, if he/she qualifies for it. If an employee wishes to take time off work in lieu of receiving statutory holiday pay, such request must be made in writing to their immediate supervisor and is subject to approval by management. This lieu day must be taken within 90 days of the holiday in question. If the request cannot be approved by management based on business needs, the employee will receive their statutory holiday pay.
10.08 (b) In order to qualify for the holiday pay as described in 5(a), the employee must have worked his/her full last scheduled shift immediately preceding and his/her full first scheduled shift following the holiday, unless employee is on vacation, approved short term disability or Personal Emergency Leave that was communicated in advance as soon as employee becomes aware of the absence but no later than timelines outlined in Article 15 (a). Employees required will follow ESA guidelines when asking for evidence reasonable in the circumstances to validate the leave in order to determine eligibility for holiday pay.
(c) When a statutory holiday falls on a Saturday or Sunday, the Employer may designate either the Friday before or the Monday after as the holiday. This section shall only apply to those employees whose scheduled work beyond the seven and one half week is Monday to Friday.
(7.5d) hours shift hours for a shift commencing The holiday shall be from 12 midnight to 12 midnight on the calendar date of day designated by the Employer as the holiday.
(e) If an employee takes his vacation during the period, which includes a Holiday designated statutory holiday, he/she shall receive compensation an extra day’s pay (regular shift) at the rate of two (2 x) times the Employee’s his/her regular hourly rate of pay for all hours worked beyond the shiftrate.
10.09 (f) Employees shall hired after April 1st and before June 30th, will be eligible for compensation under this Article only for the regular shifts where the majority entitled to one (1) floater day that year. Employees hired after June 30th will not be entitled to floater day that year.
(g) All Floater days must be taken before December 31st of shift hours occur on the calendar date of a Holiday
10.10 If one or more holidays noted in Article 10.01 occurs during the regular scheduled vacation of a Regular Employee, the Full-Time Employee shall receive holiday pay for that day. The Part-time employee shall receive pay for that day each year and are not permitted to be carried over to the extent that they have banked holiday credits. In both cases, vacation credits shall not be reduced for that day. This provision is not applicable to a Casual Employeefollowing year.
