Common use of Standardization Clause in Contracts

Standardization. Standardization of supplies, materials, equipment and services is authorized by General Municipal Law Section 103, and may be applied to a specific make, model, or type of supply, material, equipment, or services – provided it is in the best interest of BOCES, as determined by the Purchasing Agent. The Purchasing Agent shall recommend standardization only in instances where the criteria are efficiency, economy, continuity of décor, or to meet specific educational requirements. In accordance with General Municipal Law Section 103, such standardization shall require a 3/5 majority vote of the Board, and shall eliminate the need for an “or equal” provision in bid specifications. However, it shall not eliminate the need for public bids, where appropriate.
