Specifications, Validation and Testing a) For existing qualified MBE and MOCVD grown Wafers, the parties agree that that they will continue to use the same Specifications and the same validation and test procedures that currently exist prior to the execution of this Agreement. For newly developed Wafers, the Specifications and validation and test procedures will be established by the parties. All such Specifications are the exclusive Intellectual Property of RFMD and IQE shall not use such Specifications, in whole or in part, to manufacture wafers for any other party.
