Special Systems. Tenant shall have the right in common with others to connect to and use the following systems: pH neutralization system, compressed air, vacuum systems and the exhaust system (collectively, the “Special Systems”) located at the Building subject to the following conditions:
6.8.1 Tenant’s use of the Special Systems shall be at Tenant’s sole risk to the extent permitted pursuant to applicable laws (Landlord making no representation or warranty regarding the sufficiency of the Special Systems for Tenant’s use);
6.8.2 Tenant’s use of the Special Systems shall be undertaken by Tenant in compliance with all applicable laws, including Environmental Laws, and Tenant shall obtain any and all permits required in connection with Tenant’s use;
6.8.3 Tenant shall, at Tenant’s sole cost, be responsible for connecting to the central distribution point for the Special Systems to the Premises;
6.8.4 All costs pertaining to the Special Systems shall be included in the Operating Expenses. Tenant’s use of the Special Systems shall not exceed Tenant’s Share of the capacity available to tenants of any such Special System;
6.8.5 Tenant acknowledges and agrees that, except as expressly set forth in this Lease, there are no warranties of any kind, whether express or implied, made by Landlord or otherwise with respect to the Special Systems or any services (if any) provided in the Special Systems, and Tenant disclaims any and all such warranties; and
6.8.6 Landlord shall maintain the Special Systems in good working condition and repair. Landlord may, at its sole election and by prior written notice to Tenant, add additional Special Systems to the Building in the future and make the same available to all laboratory tenants, in which case such additional systems shall be treated as Special Systems hereunder.
Special Systems. 146 a. Miscellaneous Exhaust and Ventilation Systems: Provide toilet exhaust system(s) with a rate of exhaust based on a minimum of 15 air changes per hour.
Special Systems. Tenant shall have the right, at its option, to do any --------------- of the following twenty-four (24) hours per day, seven (7) days per week, 365 days per year and at any time during the Demised Term, at Tenant's expense and at no additional charge, but with Landlord's cooperation to the extent required:
(a) To reconfigure switch equipment and facilities and to make application directly to an electricity provider serving the Building for power as desired by Tenant to service the Premises. Tenant shall have the right to make its own arrangements for power.
(b) To install interruptible power supply (UPS) systems and associated batteries and equipment, transient voltage surge suppressor (TVSS) equipment, DC power plant, ATS equipment, power distribution cabinets and equipment and power panels, and to integrate the Building power into such systems.
(c) To tie into any existing grounding systems in the Building, or, at Tenant's option, to install its own electrical grounding system.
(d) To install, maintain, repair and replace from time to time, at the location outside the Building identified on Exhibit "B" to ----------- this Lease (the "Generator Pad") power generator(s) as required by Tenant, together with associated equipment and fuel tanks, to provide primary or backup power, or both, to Tenant's equipment, and to integrate Building power into such generators. Landlord shall provide, at no additional charge, easements and, if applicable, riser space as necessary to connect the generators to Tenant's equipment.
(e) To install, maintain, repair and replace from time to time an independent cooling system. Tenant shall have the right to locate its HVAC equipment outside the Building or, at Tenant's option, on the roof of the Building (the "Air Conditioning Pad"). Landlord shall provide, at no additional charge, easements and, if applicable, riser space as necessary to service the Premises from the Air Conditioning Pad. Tenant shall have the right to install coolant lines to support its air conditioning systems. Tenant shall have the right to tap into Building domestic water supply in order to operate a humidifier system in the Premises. Tenant shall have the right to vent through the Building ventilation system and to install drains for the Tenant's air conditioning systems and to discard air conditioning wastewater into the Building's sewage system. Special Systems. Subject to Landlord's approval as set forth in Article 15, below, Tenant, at its sole expense, may install self-contained HVAC units in the Premises, including, without limitation, for the purpose of servicing the Premises during hours other than the hours of the Building (the "Special Systems"). In connection with such Special Systems, Landlord may install, at Tenant's expense, a meter to measure Tenant's use of electricity and Tenant shall reimburse Landlord directly for Landlord's cost thereof. The Special Systems shall remain the personal property of Tenant during the Lease Term, and Tenant shall remove the Special Systems as of the termination or expiration of this Lease, and shall repair any damage to the Building or Premises caused by such removal.
