SPACECRAFT STORAGE. 31.1 Buyer may, at its option, order Contractor to store, in accordance with the provisions of Exhibit B Galaxy X Spacecraft Specification, the deliverable Spacecraft (including separate storage of Batteries, if needed) for a period of up to two (2) years from the date of their delivery to Buyer. HCG shall provide written notice to the Contractor not later than six (6) months prior to the scheduled delivery of said Spacecraft. Contractor's price for providing storage shall be provided to Buyer in accordance with Article 29, "Changes," (and such price shall be deemed a "Change Proposal" for purposes of Article 29) within 30 days after receipt of Buyer's notice to store such Spacecraft and Contractor shall provide storage facilities. If such storage facilities are unavailable, Contractor and Buyer shall hold discussions to determine a mutually agreed storage arrangement.

SPACECRAFT STORAGE. (A) In the event of a delay or failure to launch which is attributable to Contractor, Contractor, at its expense, shall provide for all transportation, storage (if needed), testing and refurbishment and any Work and expense of maintenance to prevent deterioration of a Spacecraft required before and until such time as a rescheduled launch can reasonably be effected.
SPACECRAFT STORAGE. Inmarsat may, at its option, require the Contractor to store one of more spacecraft beyond the contractual delivery date. Storage for an initial period of **** shall be provided by the Contractor ****, as required in Section 3.8 of this SOW. Storage longer than **** and up to a maximum of five years shall be provided by the Contractor in accordance with the short and long term storage requirements described in Section 6 of Annex J to the Contract, entitled Overall Test Plan.
SPACECRAFT STORAGE. Inmarsat shall have the option to require the Contractor to store the spacecraft beyond the contractual delivery date. Storage shall be provided by the Contractor free of charge for an initial six months. For storage durations beyond the initial free 6-month period, refer to Annex N of this contract.
SPACECRAFT STORAGE. A. If as a result of a delay or failure to launch, through no fault of Contractor, Buyer requests Contractor to store the Spacecraft within sixty (60) days of completion of in-plant acceptance testing, the Contractor shall store, at a site designated by Buyer and such site shall be subject to the approval of Contractor, or if no site is designated by Buyer, at a site designated by Contractor, the Spacecraft delivered under this Contract. Title and risk of loss to the Spacecraft to be stored shall remain with Contractor at the storage site. Contractor shall assume full responsibility for any loss or damage to the Satellite during ground storage. There shall be no charge for storage or reverification work if the Contractor's failure to perform is the reason that the Satellite is stored, or if the Satellite is stored for less than six (6) months. Should the Satellite be stored for a reason other than Contractor's failure to perform and the Spacecraft remains in storage beyond the six (6) month period, Buyer shall be responsible for all storage costs (in excess of six (6) months) and shall be responsible for paying directly or reimbursing Contractor for all direct costs actually incurred by Contractor to re-verify system flight assurance and reverification testing (in excess of six (6) months). Contractor shall be responsible, except in the event of negligence or willful misconduct by the Buyer, for all transportation cost and insurance to cover the risk and expense of loss or damage of the Spacecraft in transit, (i) from Contractor's facility to storage, (ii) from Buyer's facility to the storage site, (iii) from the storage site to the launch site or (iv) if necessary, from the storage site to the refurbishment site and then to the launch site.

HCG shall provide written notice to the Contractor not later than six (6) months prior to the scheduled delivery of said Spacecraft. Contractor's price for providing storage, including insurance and transportation to storage, shall be provided to Buyer within 30 days after receipt of Buyer's notice to store such Spacecraft and Contractor shall provide storage facilities. If such storage facilities are unavailable, Contractor and Buyer shall hold discussions to determine a mutually agreed storage arrangement.
SPACECRAFT STORAGE. Any spacecraft that has been stored for more than six (6) months after acceptance testing, through the fault of the Contractor, shall be subjected to a thorough integrated system testing at ambient conditions prior to delivery. Should the Contractor be directed by ORBCOMM Global to store any Spacecraft beyond the contractual delivery date, ORBCOMM Global shall be responsible for any associated costs.

The cost for storage and additional transportation costs exceeding that required to transport the satellite(s) to the FOB point specified herein, shall be borne by Buyer. These will be in addition to any charges which become the obligation of the Buyer per Article 18 herein entitled "Spacecraft Not Launched Within Six Months After Acceptance."
