Common use of SMALL PACKAGE PROGRAM Clause in Contracts

SMALL PACKAGE PROGRAM. If items shipped via Xxxxxxx’x Small Packages program are lost, damaged or destroyed while in Xxxxxxx’x possession, XXXXXXX’X MAXIMUM LIABILITY SHALL BE $100 per package UNLESS AT THE TIME OF SHIPMENT SHIPPER MAKES A DECLARATION OF VALUE IN THE SPACE DESIGNATED ON THE SHIPPING INSTRUCTIONS AND PAYS THE APPROPRIATE VALUATION CHARGE. If small packages are received by the Shipper and notice of loss or damage is not received by Xxxxxxx within 15 days of the delivery of the property, the parties agree that the presumption shall arise that the property was delivered in proper quantity and in good condition.
