Common use of Site Control Clause in Contracts

Site Control. Seller shall have Site Control as of the earlier of: (a) the Commercial Operation Date; or (b) any date before the Commercial Operation Date to the extent necessary for the Seller to perform its obligations under this Agreement and, in each case, Seller shall maintain Site Control throughout the Term. Seller shall promptly provide Buyer with Notice if there is any change in the status of Seller’s Site Control.

Site Control. (a) Seller shall have Site Control as of the earlier of: (ai) the Commercial Operation Term Start Date; or , and (bii) any date period before the Commercial Operation Term Start Date to the extent necessary for the Seller to perform its obligations under this Agreement and, in each case, Seller shall will maintain Site Control throughout the Term. Seller shall promptly provide Buyer with prompt Notice if there is of any change in the status of Seller’s Site Control.

At all times after the Effective Date, Seller shall ensure site control (“Site Control”) of the Premises, which means that Seller shall have Site Control as of the earlier of: (a) the Commercial Operation Date; or (b) any date before the Commercial Operation Date all rights to the extent Premises necessary for the Seller to perform its obligations under this Agreement and, in each case, Seller shall maintain Site Control throughout the TermAgreement. Seller shall promptly provide Buyer COMPANY with Notice if there is prompt notice of any change in the status of Seller’s Site Control.
