Common use of Simultaneous Adjustments Clause in Contracts

Simultaneous Adjustments. In the event that Section 2.07 requires adjustments to the Conversion Rate under more than one of Sections 2.07(l), (2) or (3), and the Record Dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 2.07(3), second, the provisions of Section 2.07(l), and third, the provisions of Section 2.07(2).

In the event that Section Sections 2.06, 2.07 requires or 2.08 require adjustments to the Conversion Rate under more than one of Sections 2.07(l2.07(1), (2), (3) or (34), and the Record Dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 2.07(3), second, the provisions of Section 2.07(l2.07(4), third, the provisions of Section 2.07(1), and thirdfourth, the provisions of Section 2.07(2).
