Common use of Simultaneous Adjustments Clause in Contracts

Simultaneous Adjustments. In the event that this Article XII requires adjustments to the Conversion Rate under more than one of Sections 12.6(4), 12.7 or 12.8, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 12.6, second, the provisions of Section 12.8 and, third, the provisions of Section 12.7.

Simultaneous Adjustments. In the event that If this Article XII X requires ------------------------ adjustments to the Conversion Rate under more than one of Sections 12.6(410.06(4), 12.7 10.07 or 12.810.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 12.610.06, second, the provisions of Section 12.8 10.08 and, third, the provisions of Section 12.710.07.

In the event that If this Article XII XI requires ------------------------ adjustments to the Conversion Rate under more than one of Sections 12.6(411.06(4), 12.7 11.07 or 12.811.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 12.611.06, second, the provisions of Section 12.8 11.08 and, third, the provisions of Section 12.711.07.

In the event that this Article XII requires adjustments to the Conversion Rate under more than one of Sections 12.6(4), 12.7 12.7, 12.8 or 12.812.9, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 12.6, second, the provisions of Section 12.8 and12.8, third, the provisions of Section 12.712.7 and, fourth, the provisions of Section 12.9.

In the event that this Article XII Thirteen requires adjustments to the Conversion Rate under more than one of Sections 12.6(4), 12.7 SECTIONS 13.06 or 12.813.07, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 12.6, SECTION 13.06 and second, the provisions of Section 12.8 and, third, the provisions of Section 12.7SECTION 13.07.

Simultaneous Adjustments. In the event that If this Article XII XI requires adjustments to the Conversion Rate under more than one of Sections 12.6(411.06(4), 12.7 11.07 or 12.811.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 12.611.06, second, the provisions of Section 12.8 11.08 and, third, the provisions of Section 12.711.07.
