Common use of Sexual Abuse & Molestation Insurance Clause in Contracts

Sexual Abuse & Molestation Insurance. Where Services include Contact (as defined in Section 18 of this Agreement) with CPS student(s), Provider shall maintain Sexual Abuse & Molestation Insurance coverage. If Provider does not have separate Sexual Abuse & Molestation Insurance, then Provider’s Commercial General Liability policy must include and not exclude Sexual Abuse & Molestation with limits of not less than Three Hundred Thousand Dollars ($300,000.00) per claim and Six Hundred Thousand Dollars ($600,000.00) in the aggregate. If coverage is claims made, the policy shall have a retroactive date effective upon the Effective Date of the Agreement and have extended reporting period of not less than two (2) years following completion of the Agreement. Any retroactive date or prior act exclusion must predate the Effective Date of this Agreement and any earlier commencement of Services.
