Common use of SERVICE PERFORMANCE REVIEW Clause in Contracts

SERVICE PERFORMANCE REVIEW. 9.1. The Parties shall, as frequently as notified by Land Bank to the Contractor, conduct a joint review of the Services in order to measure the performance of the Contractor. 9.2. In conducting the review, the Contractor undertakes to render such co-operation to Land Bank as may be required in order for Land Bank to conduct the review. 9.3. Without prejudice to any of Land Bank’s rights in terms of clause 22 below, the Parties shall record any failure by the Contractor in its performance of the Services and will agree on the: 9.3.1. actions that must be implemented to improve or rectify the performance; 9.3.2. time period within which; and 9.3.3. by whom, such actions must be implemented. 9.4. A failure by the Contractor to implement the actions referred to in clause 9.2 and 9.3 by the dates agreed by the Parties shall constitute a breach of this Agreement for the purposes of clause 22.1.

The Parties parties shall, as frequently as notified by the Land Bank to the ContractorService Provider, conduct a joint review of the Services in order to measure the performance of the ContractorService Provider. 9.28.2. In conducting the review, the Contractor Service Provider undertakes to render such co-operation to the Land Bank as may be required in order for the Land Bank to conduct the review. 9.38.3. Without prejudice to any of the Land Bank’s Bank‟s rights in terms of clause 22 21 below, the Parties parties shall record any failure by the Contractor Service Provider in its performance of the Services and will agree on the: 9.3.18.3.1. actions that must be implemented to improve or rectify the performance; 9.3.28.3.2. time period within which; and 9.3.38.3.3. by whom, such actions must be implemented. 9.48.4. A failure by the Contractor Service Provider to implement the actions referred to in clause 9.2 8.2 and 9.3 8.3. by the dates agreed by the Parties parties shall constitute a breach of this the Agreement for the purposes of clause 22.121.1.
