Common use of Seniority Usage Clause in Contracts

Seniority Usage. The employee with the earliest hire date shall receive preferential treatment regarding route package selection, shift selection, vacation periods, promotions, assignments, transfers, layoffs, and special assignments when ability and performance are substantially equal to those of employees junior to him/her. If the District determines that seniority rights should not govern in the latter cases above, because a junior employee possesses ability and performance substantially greater than a senior employee or employees, the District shall set forth in writing to the senior employee or employees who applied for the job the reason why the senior employee or employees have been bypassed.
