Common use of Section Vacation Clause in Contracts

Section Vacation. A - Vacations will be earned on the first day of the payroll year and must be taken within the following month period of that payroll year. Vacations will be based on the completed years of continuous service by the employee as of the first day of the payroll year, according to the following schedule: Years of Continuous Service Less than or more Weeks of Vacation Time Vacation Pay One day for each month of service up to a maximum of days weeks weeks weeks weeks earnings subject to the provisions of the Federal Canada Labour Code. Note An employee may only receive pay in lieu of his 5th week of vacation. Vacation time off may be taken for the 5th week only in special circumstances. The employee must request this in writing. Granting the 5th week as time off will be at the sole discretion of management. An employee shall be eligible for the additional week of vacation or vacation pay, when he has worked past his 5th and 10th anniversary date of employment. He shall be eligible for pay in lieu of his 5th week of vacation at the time he crosses his 20th anniversary date of employment. C The amount of vacation time off will be reduced by 1/52 for each straight time hours of absence for any reason (except personal illness or work- related illness or up to days annually) during the previous payroll year. In the application of this provision, an employee with to years of continuous service will not have his vacation time reduced to less than weeks. An employee with or more years of continuous service will not have his vacation time reduced to less than weeks. D Vacation pay will be paid at the time the employee takes his vacation provided the Company has days of advanced notice.
