Section 9.5.3. 21 The employee will retain accrued sick leave, vested vacation rights, and seniority rights while 22 on leave of absence. However, vacation credits, sick leave, and seniority shall not accrue while 23 the employee is on leave of absence; provided, however, that if such leave is approved for 24 extended illness or injury, seniority shall accrue.

Employees recalled from layoff shall begin, effective 21 with the first day of work in the new assignment, a secondary probationary period of sixty (60) 22 calendar days duration. During the secondary probationary period, the retention of the 23 employee in the newly assigned position shall be solely and entirely at the discretion of the 24 District. If the District determines that the employee is unsuccessful or is likely to be 25 unsuccessful in the assigned position, the employee may be returned to the layoff pool for a 26 possible later assignment according to provisions of this Article.
Section 9.5.3. 26 Adoptive leave shall be granted for eligible employees under FMLA guidelines. For 27 employees not eligible for FMLA leave, adoptive leave shall be limited to 15 days in any 12 28 month time period and may be used for court/legal proceedings, home study or other processes 29 related to the adoption of the child as well as care of the child upon placement. Adoptive leave 30 shall be deducted from the employee’s available leave(s).

They may not, however, continue to advise the employee on courses of 18 action after the employee has indicated a desire not to pursue a grievance. This does not, however, 19 preclude the Association's right to pursue the matter to conclusion. They may consult with the District 20 on complaints without a grievance being made by an individual employee.
