SECOND INCIDENT Clause Samples
The "Second Incident" clause defines the consequences or procedures that apply when a second occurrence of a specified event or breach happens under an agreement. Typically, this clause outlines stricter remedies or escalated actions compared to a first incident, such as automatic termination, increased penalties, or additional obligations. For example, if a party repeatedly fails to meet a deadline, the second failure may trigger more severe consequences than the first. The core function of this clause is to deter repeated non-compliance and provide a clear framework for handling recurring issues, thereby protecting the interests of the non-breaching party.
