Second Floor Space Clause Samples
Second Floor Space. Landlord and Tenant agree that at the time of the execution of this Lease, the balance of the rentable space on the second (2nd) floor of the Building (“Second Floor Space”) is presently available for leasing. Landlord agrees to notify Tenant on the first occasion that Landlord intends to respond to a request for proposal (or intends to respond to an initial offer from a third party without a prior request for proposal) for all or any part of the Second Floor Space after the date of this Lease. Nothing contained in this Section 32.13 shall be deemed to grant Tenant a right of first refusal or right of first offer for the Second Floor Space, it being the intention of the Landlord and Tenant that the notification under this Section 32.13 is solely for the purpose of affording the Tenant the opportunity to offer to lease additional space on the second floor prior to the next leasing of such space after the execution of this Lease.
Second Floor Space. On the earlier of (a) September 1, 1999 or (b) the ------------------ date of Tenant's final Draw Request, as provided in the Work Letter attached hereto as Exhibit C (the "Second Floor Commencement Date"), the description of --------- the Premises shall also be amended to include approximately 5,619 square feet of additional space on the second floor of the Building, as depicted on Exhibit B --------- attached hereto and made a part hereof (the "Second Floor Space") and hereafter all references to the Premises shall include such Second Floor Space.
▇. ▇▇▇▇▇▇'s right to occupy and obligation to pay Base Rent and ▇▇▇▇▇▇'s Pro Rata Share of Operating Expenses on the Second Floor Space shall commence on the Second Floor Commencement Date and shall terminate with the Lease Term.
B. Commencing on the Second Floor Commencement Date, Tenant shall pay to Landlord, in advance, on the first day of each month during the term of the Lease, Base Rent for the Second Floor Space at the same per-square-foot rate effective during the Lease for the Premises (including step-ups), as follows:
Second Floor Space. The parties acknowledge that the premises include space on the second floor of the Building which Tenant has been occupying (the "Second Floor Space"). As rent for the Second Floor Space, Tenant shall continue to pay Landlord the sum of $250 per month during the term of the lease as the same may be extended. Tenant shall have the right to discontinue its lease of the Second Floor Space upon 30 days prior written notice to Landlord in which event Tenant shall be relieved of all obligations with respect to the Second Floor Space including the obligation to pay rent for the Second Floor Space. The Second Floor Space shall not be included in calculating Tenant's Pro-Rata Share.

Second Floor Space. On or before the Effective Date, Landlord shall deliver the Second Floor Space broom-clean, with all fixtures, debris and personal property of former tenants removed. If the Second Floor Premises shall be vacated by its current tenants prior to the Effective Date, Landlord shall deliver the same to Tenant for purposes of commencing Tenant’s Work. Tenant’s possession of the Second Floor Premises prior to the Effective Date for such purposes shall be subject to all the terms and conditions of the Lease, except that no Rent shall be due or payable for such space during such early occupancy.
