Scheduling Failure. For the avoidance of doubt, in the case of a GTA for Firm Services, it is clarified that if failure to schedule by Transporter is due to failure of the Upstream Operator or the Upstream Pipeline Operator or Downstream Pipeline Operator to confirm the nomination in accordance with the Section 5.3 of this Code prior to scheduling, then any such quantity shall not be included in the Shortfall Quantity and Transporter shall have no liability under such GTA for Shortfall Quantity.
