Common use of Schedule Coordination Clause in Contracts

Schedule Coordination. If, as a result hereof, PacifiCorp is deemed by an RTO to be financially responsible for Seller's performance under the Generation Interconnection Agreement, due to Seller's lack of standing as a "scheduling coordinator" or other RTO recognized designation, qualification or otherwise, then Seller shall acquire such RTO recognized standing (or shall contract with a third party who has such RTO recognized standing) such that PacifiCorp is no longer responsible for Seller's performance under the Generation Interconnection Agreement or RTO requirement. Notwithstanding the foregoing: (i) the Parties agree that PacifiCorp will assume all “scheduling coordinator” responsibilities and bear all financial costs associated with this obligation on behalf of Seller unless the System becomes part of an RTO; and (ii) if the System becomes part of an RTO at some point in the future the Parties will determine the “scheduling coordinator” roles and responsibilities based on the rules of the RTO at that time.
