Common use of Satisfaction of Sinking Fund Payments with Securities Clause in Contracts

Satisfaction of Sinking Fund Payments with Securities. In lieu of making all or any part of any mandatory sinking fund payment with respect to any series of Securities in cash, the Company may at its option (a) deliver to the Trustee Securities of such series theretofore purchased or otherwise acquired (except upon redemption pursuant to the mandatory sinking fund) by the Company or receive credit for Securities of such series (not previously so credited) theretofore purchased or otherwise acquired (except as aforesaid) by the Company and delivered to the Trustee for cancellation pursuant to Section 309 hereof, (b) receive credit for optional sinking fund payments (not previously so credited) made pursuant to this Section 1202, or (c) receive credit for Securities of such series (not previously so credited) redeemed by the Company through any optional redemption provision contained in the terms of such series. Securities so delivered or credited shall be received or credited by the Trustee at the sinking fund Redemption Price specified in such Securities.

In lieu of making all or any part of any mandatory sinking fund payment with respect to any series of Securities in cash, the Company may may, at its option option, (ai) deliver to the Trustee Securities of such series theretofore purchased or otherwise acquired (except upon redemption pursuant to the mandatory sinking fund) by the Company or receive credit for Securities of such series (not previously so credited) theretofore purchased or otherwise acquired (except as aforesaid) by the Company and delivered to the Trustee for cancellation pursuant to Section 309 hereof310, (bii) receive credit for optional sinking fund payments (not previously so credited) made pursuant to this Section 1202Xxxxxxx 0000, or xx (cxxx) receive credit for Securities of such series (not previously so credited) redeemed by the Company through any optional redemption provision contained in the terms of such series. Securities so delivered or credited shall be received or credited by the Trustee at the sinking fund Redemption Price specified in such Securities.

Securities so delivered or credited shall be received or credited by the Trustee at the sinking fund Redemption Price specified in such Securities.

Securities so delivered or credited shall be received or credited by the Trustee at the sinking fund Redemption Price specified in such Securities. SECTION 1203.

Satisfaction of Sinking Fund Payments with Securities. In lieu of making all or any part of any mandatory sinking fund payment with respect to the Securities of any series of Securities in cash, the Company Corporation may at its option (a) deliver i)deliver to the Trustee Securities of such series theretofore purchased or otherwise acquired (except upon redemption pursuant to the any mandatory sinking fundfund payment) by the Company Corporation or receive credit for Securities of such series (not previously so credited) theretofore purchased or otherwise acquired (except as aforesaidforesaid) by the Company Corporation and delivered to the Trustee for cancellation pursuant to Section 309 hereof, 3.09; (b) receive ii)receive credit for any optional sinking fund payments (not previously so credited) made pursuant to this Section 1202, Section; or (c) receive iii)receive credit for any Securities of such series (not previously so credited) redeemed by the Company Corporation through any optional redemption provision contained in the terms of such series. Such Securities so delivered or credited shall be received or and credited for such purpose by the Trustee at the sinking fund Redemption Price specified in such SecuritiesSecurities for redemption through operation of the sinking fund therefor and the amount of such mandatory sinking fund payment shall be reduced accordingly.

Satisfaction of Sinking Fund Payments with Securities. In lieu of making all or any part of any mandatory sinking fund payment with respect to any series of Securities in cash, the Company may at its option (a) deliver to the Trustee Securities of such series theretofore purchased or otherwise acquired (except upon redemption pursuant to the mandatory sinking fund) by the Company or receive credit for Securities of such series (not previously so credited) theretofore purchased or otherwise acquired (except as aforesaid) by the Company and delivered to the Trustee for cancellation pursuant to Section 309 hereof313, (b) receive credit for optional sinking fund payments (not previously so credited) made pursuant to this Section 1202, or (c) receive credit for Securities of such series (not previously so credited) redeemed by the Company through any optional redemption provision contained in the terms of such series. Securities so delivered or credited shall be received or credited by the Trustee at the sinking fund Redemption Price specified in such Securities.

Securities so delivered or credited shall be received or credited by the Trustee at the sinking fund Redemption Price specified in such Securities.

Satisfaction of Sinking Fund Payments with Securities. In lieu of making all or any part of any mandatory sinking fund payment with respect to any series of Securities in cash, the Company Issuer may at its option (a) deliver to the Trustee Securities of such series theretofore purchased or otherwise acquired (except upon redemption pursuant to the mandatory sinking fund) by the Company Issuer or receive credit for Securities of such series (not previously so credited) theretofore purchased or otherwise acquired (except as aforesaid) by the Company Issuer and delivered to the Trustee for cancellation pursuant to Section 309 hereof309, (b) receive credit for optional sinking fund payments (not previously so credited) made pursuant to this Section 1202Section, or (c) receive credit for Securities of such series (not previously so credited) redeemed by the Company Issuer through any optional redemption provision contained in the terms of such series. Securities so delivered or credited shall be received or credited by the Trustee at the sinking fund Redemption Price specified in such Securities. Tier 2 Securities may not be purchased by the Issuer thereof, any Subsidiary or the Guarantors at any time except in accordance with the Financial Services Authority Practices.
