Same Kind and Size Clause Samples
The "Same Kind and Size" clause requires that any replacement, substitution, or addition of items under a contract must match the original items in both type and dimensions. In practice, this means that if a product or component needs to be replaced, the new item must be of the same model, material, and measurements as the one specified or previously provided. This clause ensures consistency and compatibility throughout the project or transaction, preventing disputes over mismatched or unsuitable replacements and maintaining the intended quality and functionality.
Same Kind and Size. Plants used for replacement shall be the same kind and not less than the size specified and shall be furnished, planted and fertilized as originally specified, unless otherwise directed by City in writing. Cost of all repair work to existing improvements damaged during replacement shall be borne by Developer.
