Safety Net. An employee’s salary will not be less than the Fairness Test applied by the Workplace Authority, contemplating the minimum wage rates and penalty payments. The fairness test will be applied against the relevant awards to ensure that employees are not disadvantaged in terms of wages or salaries paid as well as any protected award conditions. For the purposes of the fairness test, the salary in clause 6.1 and the conditions of employment in this agreement will, as a whole, exceed the wages and protected conditions of employment of the Clerical and Administrative Employees (Victoria) 1999, or any other award used for such assessment, at the time of lodgment.
