Common use of Right to Petition Court Clause in Contracts

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 and 12 above and the Trust fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority to enforce the Trust’s obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 8 and 12 above 9 and the Trust Fund fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority district court to enforce the TrustFund’s obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 2 and 5 3 above or a request for an advancement of Indemnifiable Expenses under Sections 11 4 and 12 5 above and the Trust Indemnitor fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority a court of law to enforce the Trust’s Indemnitor's obligations under this Agreement.

Right to Petition Court. In the event that the Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 and Section 3 or Section 5 above hereof or a request for an advancement of Indemnifiable Expenses under Sections 11 and 12 above 8 or 9 hereof and the Trust Company fails to make such payment or advancement in a timely manner pursuant to in accordance with the terms of this Agreement, the Indemnitee may petition the appropriate judicial authority a court to enforce the TrustCompany’s obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3,4 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 10 and 11 and 12 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority to enforce the TrustCompany’s obligations under this Agreement.

In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 6 above or a request for an advancement of Indemnifiable Expenses under Sections 11 9 and 12 10 above and the Trust fails Companies fail to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority to enforce the Trust’s Companies’ obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 8 and 12 9 above and the Trust Corporation fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority to enforce the TrustCorporation’s obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 9 and 12 10 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority any court which has jurisdiction to enforce the TrustCompany’s obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 6 above or a request for an advancement of Indemnifiable Expenses under Sections 11 9 and 12 10 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority to enforce the TrustCompany’s obligations under this Agreement.

In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 8 and 12 9 above and the Trust fails Indemnitors fail to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority a court of competent jurisdiction to enforce the Trust’s Indemnitors ’ obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 2 and 4 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 7 and 12 8 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition file a writ with the appropriate judicial authority court set out in Section 22 to enforce order for enforcement the TrustCompany’s obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 Section 3 and Section 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 Section 8 and 12 Section 9 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this AgreementDeed, Indemnitee may petition the appropriate judicial authority a court of law to enforce the TrustCompany’s obligations under this AgreementDeed.

Right to Petition Court. In the event that Indemnitee makes a ----------------------- request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 8 and 12 9 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority Superior Court to enforce the Trust’s Company's obligations under this Agreement.

Right to Petition Court. In the event that the Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 Section 3 and Section 5 above herein or a request for an advancement of Indemnifiable Expenses under Sections 11 Section 8 and 12 above Section 9 herein and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, the Indemnitee may petition the appropriate judicial authority a court to enforce the TrustCompany’s obligations under this Agreement.

In the event that Indemnitee makes a request for payment of Indemnifiable Indenmifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 8 and 12 9 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority to enforce the Trust’s Company's obligations under this Agreement.

In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 8 and 12 9 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority any court which has jurisdiction to enforce the TrustCompany’s obligations under this Agreement.

In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 10 and 11 and 12 above and the Trust fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority to enforce the Trust’s obligations under this Agreement.

In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 6 above or a request for an advancement of Indemnifiable Expenses under Sections 11 7 and 12 8 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority a court of competent jurisdiction to enforce the TrustCompany’s obligations under this Agreement, including to challenge a Negative Determination.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 10 and 11 and 12 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority to enforce the Trust’s Company's obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 8 and 12 9 above and the Trust Corporation fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority Court of Chancery to enforce the TrustCorporation’s obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 8 and 12 above 9 and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority Court of Chancery to enforce the TrustCompany’s obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 8 and 12 9 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority a court of competent jurisdiction to enforce the Trust’s Company's obligations under this Agreement.

Right to Petition Court. In the event that the Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above above, or a request for an advancement advance of Indemnifiable Expenses under Sections 11 8 and 12 above 9 above, and the Trust Company fails to make such payment or advancement advance in a timely manner pursuant to the terms of this Agreement, the Indemnitee may petition the appropriate judicial authority a court of law to enforce the TrustCompany’s obligations under this Agreement.

Right to Petition Court. In the event that Indemnitee makes a request for payment of Indemnifiable Amounts under Sections 3, 4 3 and 5 above or a request for an advancement of Indemnifiable Expenses under Sections 11 9 and 12 10 above and the Trust Company fails to make such payment or advancement in a timely manner pursuant to the terms of this Agreement, Indemnitee may petition the appropriate judicial authority any court which has jurisdiction to enforce the Trust’s Company's obligations under this Agreement.
