Common use of Right to Perform for Program Lessee Clause in Contracts

Right to Perform for Program Lessee. If the Program Lessee shall fail to make any Lease Payment required to be made hereunder, or shall fail to perform or comply with any of its other agreements contained herein or in any other Basic Document or any other agreement entered into in connection therewith, the Program Lessor may, but shall not be obligated to, make such payment or perform or comply with such agreement, and the amount of such payment and the amount of all costs and expenses (including, without limitation, reasonable attorneys' and other professionals' fees and expenses) of the Program Lessor incurred in connection with such payment or the performance of or compliance with such agreement, as the case may be, together with interest thereon, at the Class A-4 Interest Rate, shall be due and payable by the Program Lessee upon demand.
