Common use of Right to Develop Independently Clause in Contracts

Right to Develop Independently. Except as otherwise expressly set forth in this Agreement, nothing in this Agreement shall impair either Party’s right to independently acquire, license, develop for itself, or have others develop for it, intellectual property and technology performing similar functions as the other Party’s intellectual property or to market and distribute products or services based on such other intellectual property and technology.

Right to Develop Independently. Except as otherwise expressly set forth in this Agreement, nothing Nothing in this Agreement shall will impair either any Party’s right to independently acquire, license, develop for itself, or have others develop for itdeveloped, intellectual property utilize or otherwise exploit information and technology performing with the same or similar uses or functions as the other Partyinformation or technology that is the subject of the Agreement’s intellectual property Technical Areas or any prototype project issued pursuant to market and distribute products or services based on such other intellectual property and technologythis Agreement.
