Right to Develop Independently. Except as otherwise expressly set forth in this Agreement, nothing in this Agreement shall impair either Party’s right to independently acquire, license, develop for itself, or have others develop for it, intellectual property and technology performing similar functions as the other Party’s intellectual property or to market and distribute products or services based on such other intellectual property and technology.
Right to Develop Independently. Subject to the obligations expressly provided herein, nothing in this Agreement will impair either party’s right to acquire, license, develop, manufacture or distribute for itself, or have others develop, manufacture or distribute for it, similar technology performing the same or similar functions as the technology contemplated by this Agreement, or to market and distribute such similar technology.

Nothing in this Agreement will impair ACORDA’s right to independently acquire, license, develop, or have others develop for it, products similar to or performing functions similar to Product, or similar technology performing similar functions to the Products or to market and distribute products based on other technology.

Nothing in this Agreement will impair CNPI's right to independently acquire, license, develop or have developed, utilize or otherwise exploit similar information and technology performing the same or similar functions as the information and technology provided by the Principal Investigator and/or GLADSTONE. In addition, nothing in this Agreement is intended to prohibit Principal Investigator from independently collaborating with academic, non-commercial parties on the Research Program with the prior written consent of CNPI. CNPI hereby acknowledges that the Principal Investigator intends to enter into an agreement with Lawrxxxx Xxxermore National Laboratory to perform the crystallography work of the Research Program and consents to such arrangement.
