Common use of Returned Collections Clause in Contracts

Returned Collections. For the purposes of this Section 8.1, if and to the extent the Administrative Agent, any Funding Agent, the Collateral Agent or any Class A Lender shall be required for any reason to pay over to an Obligor any amount received on its behalf hereunder, such amount shall be deemed not to have been so received but rather to have been retained by the Borrower and, accordingly, the Administrative Agent, such Funding Agent, the Collateral Agent, the Account Bank or such Class A Lender, as the case may be, shall have a claim against the Borrower for such amount, payable pursuant to the Flow of Funds above.
