Common use of Retention of Department's Right Clause in Contracts

Retention of Department's Right. Notwithstanding any assignment or transfer of this Loan Agreement pursuant to Section 11.01 or otherwise, and anything else to the contrary contained herein, the Department shall have the right upon the occurrence of an Event of Default to take any action, including (without limitation) bringing an action against the City at law or in equity, as the Department may, in its discretion, deem necessary to enforce the obligations of the City to the Department.‌
