Restrictive Trade Practices. Notwithstanding any other provision of this Agreement, no provision of this Agreement which is of such a nature as to make this Agreement liable to registration under the Restrictive Trade Practices Act 1976 shall take effect until the day after that on which particulars thereof have been duly furnished to the Director General of Fair Trading pursuant to the said Act. For the purposes of this Clause 34.16, the expression "this Agreement" shall include any agreement forming part of the same arrangement.

Notwithstanding any other provisions of this Amendment Agreement No. 2, each party declares that it shall not give effect, and shall procure that none of its Subsidiaries shall give effect, to any restriction or restrictions contained in this Amendment Agreement No. 2 which cause this Amendment Agreement No. 2 to be registrable under the Restrictive Trade Practices Act 1976 until one day after particulars of this Amendment Agreement No. 2 shall have been furnished to the Director General of Fair Trading. For the purposes of this Section 3.06, "Amendment Agreement No. 2" shall include any other agreement which, together with this Amendment Agreement No. 2, may form part of an agreement for the purposes of the Restrictive Trade Practices Act 0000.

Notwithstanding any other provisions of this Agreement, each party declares that it shall not give effect, and shall procure that none of its Subsidiaries shall give effect, to any restriction or restrictions contained in this Agreement which cause this Agreement to be registrable under the Restrictive Trade Practices Act 1976 until one day after particulars of this Agreement shall have been furnished to the Director General of Fair Trading. For the purposes of this Section 8.9, "Agreement" shall include any other agreement which, together with this Agreement, may form part of an agreement for the purposes of the Restrictive Trade Practices Act 0000.
