Responsibility for Hazardous Waste Remediation Costs. The City shall be responsible for all damages, fines or penalties, expenses, fees, claims and costs incurred from remediation and cleanup of any Hazardous Waste within the Project Limits which is discovered prior to Letting or during Construction.

Notwithstanding the foregoing, the Secretary shall be responsible for all damages, fines or penalties, expenses, claims and costs incurred from remediation and cleanup of any Hazardous Waste within the Project Limits associated with the Auxiliary Lanes which is discovered prior to Letter or during Construction.
