Resource Allocations. Pending approval of any Basic Planning Statement, Development Plan, land use plan or resource management plan, Manitoba and Split Lake Cree shall refer to the Board requests for resource allocations, including any applications for land use permits, under consideration by Manitoba or Split Lake Cree, with respect to lands and resources within the Resource Management Area. The Board may, within forty-five (45) days of referral, submit resolutions with respect to such allocations or land uses in accordance with section 5.8 of this Article. In the absence of a resolution being submitted within the time provided, Manitoba may process the said applications for land use permits, and Manitoba and Split Lake Cree may act upon requests for resource allocations within their respective jurisdictions. Requests for resource allocations or applications for land use permits received prior to the establishment of the Board will be deferred pending it being established, and then referred to the Board.

Resource Allocations. During the first [***] following the Effective Date, Ionis will use Commercially Reasonable Efforts to build a team of [***] FTEs to perform the activities under the Core Research Plan, the Neurological Disease Research Plan, and the target validation activities contemplated under Schedule 1.2.4; and thereafter until the sixth anniversary of the Effective Date, Ionis will dedicate [***] FTEs to perform such activities; provided, Ionis may utilize such number of such [***] FTEs to perform drug discovery activities on ALS Targets as agreed by the Neurology JRC. At all times during such period, such FTEs will have experience and qualifications similar to that of the FTEs initially assigned to perform such activities hereunder. Biogen will be responsible for devoting its resources toward specific research efforts under the Core Research Program and Neurological Disease Research Program as reasonably determined by Biogen. During the [***] after the Effective Date, [***] of Ionis’ [***] FTEs will be allocated to activities focused on core technology research and the Neurology JRC will determine the appropriate allocation of resources thereafter. Ionis will update the Neurology JRC at each meeting thereof on the utilization of such FTEs and provide the Neurology JRC with summaries of resource and FTE utilization in a format mutually agreed to by each Party’s Alliance Managers. Biogen may also choose to supplement Ionis’ efforts under the Core Research Plan and the Neurological Disease Research Plan with its own scientists at various points throughout the Research Term. After the sixth anniversary of the Effective Date, Ionis will provide sufficient resources to perform its obligations under each Collaboration Program as reasonably determined by Ionis.

Since case files lay throughout the facility, with those to be reviewed in stacks of 25 in accordance with the date of entry, and completed case files in shelves, in open areas, security is not adequate to prevent theft or modification of case files materials. • Databases that permit information storage, statistical analysis and rapid identification of materials are rudimentary at best. • Insufficient number of backups and UPSs to guarantee security of information maintained electronically. • Lack of clarity on what constitutes a closed case file. A cursory reading of the UTR reports, and even the manner in which the Purging Unit has operated thus far, indicates that there is confusion as to whether closing of a case is achieved by the certification by a secretary of the actions of a judge who dismisses the charges or whether public notification is required. Resource Allocations. The Norway House Resource Management Board may make recommendations to Chief and Council on behalf of Norway House Cree Nation, and Manitoba on any requests or applications for resource allocations or Land Use Permits with respect to Resources in the Norway House Resource Management Area. Chief and Council on behalf of Norway House Cree Nation, and Manitoba shall forward such requests or applications to the Norway House Resource Management Board for its consideration not less than forty-five (45) days prior to the granting or rejection thereof. Within forty-five (45) days of receiving such requests or applications, the Norway House Resource Management Board may submit recommendations on the resource allocations or Land Use Permits in accordance with Article 5.6. In the absence of a recommendation being submitted by the Norway House Resource Management Board within the time provided, Chief and Council on behalf of Norway House Cree Nation, and Manitoba may act upon such requests or applications.
