Common use of Reservations of Rights Clause in Contracts

Reservations of Rights. The foregoing enumeration of rights, prerogatives, and responsibilities is not all-inclusive and shall not be construed to abridge others. All rights, powers, and authority which the Employer has ever had heretofore, except those specifically abridge or modified by this Agreement, are retained by the Employer. The Employer’s failure to exercise any of its rights shall not constitute a waiver of such rights.
