Reselling Our services. When You are authorized to resell Our services by the contractual conditions that are applicable to each of Our services, You must always respect all of Our Contracts as well as Canadian law, and to be sure that Your own customers also respect Canadian law and the rights of third parties. By reselling Our services, You commit to: • offer Your clients the same level of service quality as provided by Walled Networks, and to respect the same ethical standards in this context, • passing on to Your own clients at least the obligations stated in this Contract, • ensure that Your clients respect all the obligations stated in this Contract, • respect all the obligations and responsibilities resulting from the Contract with regards to Your clients and/or third parties, in addition to those incumbent on web hosting companies, according to applicable law, • abide by applicable law pertaining to the protection of personal information, • act in a way which ensures that Walled Networks is never bothered due to Your activities and/or Your use of Our services, whether professional or not, including as a reseller, • Assure that, before reselling any of Our services, that Your customer does not participate, directly or indirectly, in spamming activity, registered in the "SPAMHAUS" registry (Spamhaus Register of Known Spam Operations – ROKSO, freely available for consultation at xxxx://xxx.xxxxxxxx.xxx), and/or is not listed in it, and You guarantee Walled Networks of this, • defend and hold harmless Walled Networks to any prejudice or any sentence that should result, either directly or indirectly, from Your activities and Your use of Our services, or the use of third parties through Your intermediary. This obligation shall survive the termination of the Contract, • insure Your activity in order to cover all damage that it may incur, and to be able to effectively guarantee Your commitments with regards to Walled Networks. In the event of a cessation of Your activity, You will find someone to take over the management of the services associated with Your reseller account, and to inform Your customers of this. We may help You find Your replacement, or may offer to handle the management of the aforementioned services directly ourselves for Your customers. You therefore give Us authorization to directly contact customers that benefit from Walled Networks' services that You resell, in order to allow Us to take over the management of the services subscribed to. Walled Networks will give full liberty to Your customers to choose another provider if they so wish, within the limits of Our Contracts. At any rate, it is Your responsibility to assure that You already have obtained the agreement of You customers with regards to Our recovery of Your customers in the event that You stop using or close Your reseller account for any reason, or cease Your activity.

Reselling Our services. When You are authorized to resell Our Gandi SSL services under the condition that You abide by the contractual conditions that are applicable to each of Our services, You must always respect all of Our Contracts and the Gandi CA CPS (xxxx://xxx.xxxxx.xxx/ssl/documentation) as well as Canadian lawall applicable texts, notably in France, and to be sure that You assure that Your own customers also respect Canadian abide by current applicable local law and the rights of third parties. You must provide Your customers, at all times, with an updated version of Gandi CA's CPS. Specifically, You acknowledge and accept that it is Your personal responsibility to proceed with obtaining the necessary declarations and authorizations, as the case may be. If this is not done, You will be considered as responsible, both with regards to Gandi as well as third parties of these missing authorizations, and its consequences. By reselling Our services, You commit to: • agree to offer Your clients the same level of service quality as provided by Walled NetworksXxxxx. In this respect, and You agree to respect the same ethical standards in this context, • passing pass on to Your own clients at least the obligations stated in this ContractContract and, • more particularly, You agree to ensure that Your clients respect all the obligations stated in this ContractContract and the applicable laws of France. In addition, • respect all the obligations and responsibilities resulting from the Contract You agree to respect, with regards to Your clients and/or third parties, all the obligations and responsibilities resulting from the present Contract, in addition to those incumbent on web hosting companiesthat result from the application of local laws, according notably of France, or from the Gandi CPS. You acknowledge that Xxxxx is in control of the validation of requests and the issuing of Gandi SSL Certificates even in the event that You resell the service. You agree to applicable law, • abide by applicable law pertaining to the protection of personal information, • act in a way which ensures that Walled Networks Gandi is never bothered due to Your activities and/or Your use of Our services, whether professional or not, including as a reseller, • Assure that, before reselling any of Our services, that Your customer does not participate, directly or indirectly, in spamming activity, registered in the "SPAMHAUS" registry (Spamhaus Register of Known Spam Operations – ROKSO, freely available for consultation at xxxx://xxx.xxxxxxxx.xxx), and/or is not listed in it, and . You guarantee Walled Networks of this, • explicitly agree to defend and hold harmless Walled Networks Gandi to any prejudice or any sentence that should result, either directly or indirectly, from Your activities and Your use of Our services, or the use of third parties through Your intermediary. This obligation shall survive the termination of the Contract. Specifically, • You agree to insure Your activity in order to cover all damage that it may incur, and to be able to effectively guarantee Your commitments with regards to Walled Networks. In the event of a cessation of Your activity, You will find someone to take over the management of the services associated with Your reseller account, and to inform Your customers of this. Reselling Our services. When You are authorized to resell Our Gandi SiteMaker services by the contractual conditions that are applicable to each of Our services, as long as You must always respect all Our Contracts, all legislation in force, specifically of Our Contracts as well as Canadian lawFrance, and to be sure as long as You ensure that Your own customers also respect Canadian law the legislation in force and the rights of third parties. By default, You will be considered as liable, both to Gandi and third parties, with regards to any non-compliance with these points and their consequences. In this respect, • passing You agree to pass on to Your own clients at least the obligations stated in this ContractContract and, • more particularly, You agree to ensure that Your clients respect all the obligations stated in this Contract, • respect as well as the applicable French laws. Additionally, You agree to pass on all the obligations and responsibilities resulting from the stated in this Contract with regards to Your own clients and/or third parties, in addition to (if the case may be) those incumbent to editors (if You make space on web hosting companiesYour own website available using Our Gandi SiteMaker solutions), according in application of current local laws, notably those of France. In particular, You engage and guarantee that You will be able to applicable lawcommunicate to Us, • abide by applicable law pertaining without delay and upon first request, if relevant, in accordance with the laws in force, the data necessary to identify Your final customers, with whom Xxxxx has no link. Failing this, You will be considered as responsible of this failure, and You will be identified for third parties as the protection editor of personal informationall website created through Your Gandi SiteMaker Reseller Account, • except reception of a contradictory proof that You would bring. You agree to act in a way which ensures that Walled Networks Xxxxx is never bothered due to Your activities and/or Your use of Our services, whether professional or not, including as a reseller, • Assure that, before reselling any of Our services, that Your customer does not participate, directly or indirectly, in spamming activity, registered in the "SPAMHAUS" registry (Spamhaus Register of Known Spam Operations – ROKSO, freely available for consultation at xxxx://xxx.xxxxxxxx.xxx), and/or is not listed in it, and Reseller.
