ReschedulingofTests. If the Independent Engineer certifies to HPGCL and the Mine Developer andOperator that it is unable to issue the Completion Certificate because of events orcircumstances an account of which Tests could not be held or had to be suspended,the Mine Developer and Operator shall beentitled to re-schedule the Tests andhold the same as soon as reasonably practicable. Provided, however, that the MineOperator shall be excused for the delay in Tests arising hereunder if such delay isnotsolely attributabletotheMineDeveloper andOperator.
