Common use of Requisition of Aircraft for Use by Governmental Authorities Clause in Contracts

Requisition of Aircraft for Use by Governmental Authorities. In the event of the requisition, unless and until such requisition becomes an Event of Loss, for use of the Airframe and the Engines or engines installed on such Airframe during the Term by any governmental authority, Lessee shall notify Lessor of such requisition, and, unless and until such requisition becomes an Event of Loss, all of Lessee's obligations under this Lease with respect to the Aircraft shall continue to the same extent as if such requisition had not occurred. All payments received by Lessor or Lessee from such governmental authority for the use of such Airframe and Engines or engines prior to the time such requisition becomes an Event of Loss shall be paid over to, or retained by, Lessee (or, if directed by Lessee, any Permitted Sublessee); and all payments received by Lessor or Lessee from such governmental authority for the use of such Airframe and Engines or engines after such time shall be paid over to, or retained by, Lessor unless Lessee shall have fully performed or, concurrently therewith, will fully perform the terms of Section 10.1 with respect to such Event of Loss.

All payments received by Lessor or Lessee from such governmental authority for the use of such Airframe and Engines or engines prior to the time such requisition becomes an Event of Loss shall be paid over to, or retained by, Lessee (or, if directed by Lessee, any Permitted Sublessee); and all payments received by Lessor or Lessee from such governmental authority for the use of such Airframe and Engines or engines after such time shall be paid over to, or retained by, Lessor unless Lessee shall have fully performed Indenture Trustee or, concurrently therewithif the Trust Indenture is no longer in effect, will fully perform Lessor, and upon the performance by Lessee of the terms of Section 10.1 with respect to such Event of Loss, shall be paid over to Lessee.
