Request for Substitution Clause Samples

Request for Substitution. A request by Contractor to substitute an equal or superior material, product, thing, or service for a specific material, product, thing, or service that has been designated in the Contract Documents by a specific brand or trade name.
Request for Substitution. All requests for substitution must provide a detailed explanation of the circumstances necessitating the proposed substitution, a resume for the proposed substitute, and any other information as requested by the KO. All proposed substitutes must have qualifications equal to or higher than the qualifications of the person to be replaced. The KO or his authorized representative will evaluate such requests and promptly notify the contractor of the approval or disapproval thereof.
Request for Substitution. The Publisher may request a substitution for the edition currently recommended provided that: • The original contract price and contract date do not change, and the original contract price applies for the substituted material. • The revised edition is compatible with the earlier edition, permitting use of either or both in the same classroom. • A sample copy of the contracted and revised edition is provided to the USOE Instructional Materials Specialist for examination purposes prior to the approval of the substitution. The Commission shall make the final determination about the substitution of a new edition for a previously recommended edition with assistance from the USOE subject area specialist. If the Commission approves the substitution, the publisher agrees to submit an updated version of the program or textbook to the NIMAC for use in the creation of Braille, large print, or other formats for students with print disabilities as indicated in Senate Bill 99 of 2002, section 53A-25a-105.

Request for Substitution. Any request by Contractor, pursuant to Article 3.26 of this Agreement, to provide a substitute for a Named Product. Retention - A defined percentage of the Service Work Order Sum held by the Owner pending Completion of the Work. Samples - Physical examples that illustrate materials, equipment or workmanship and establish standards by which the Work will be evaluated. Schedule of Values or SOV - A document jointly developed and approved by Contractor and the Owner reflecting the portions of the Service Work Order Sum allotted for payment upon completion of the performance of various parts of the Work.
Request for Substitution. A.5.2.1 The Contract Price is based upon the materials, equipment, methods, processes and plans identified and named in the DBA. Substitution or variance to those specified will not be permitted without submission, review and consideration by the City in accordance with this Schedule 18. A.5.2.2 Design Builder may send a RFS requesting a substitution or variance from the DBA with respect to material, equipment, processes or plans of equal or better performance and quality in substitution for those specified if it meets the Technical Requirements. A.5.2.3 Design Builder may proceed with the substitution or variance only if the City returns a response to the RFS permitting the substitution or variance and formalizes the change to the DBA in accordance with Schedule 17 – Change Orders. For clarity, permission from the City is required prior to proceeding with any substitution outlined in the RFS. A.5.2.4 Design Builder shall prepare a RFS template and shall use such template throughout the Project Term. The RFS template shall include: title of RFS; date prepared; prepared by; document number as issued by the City DMS; revision number to the RFS; description or details of the request; and space for City response.
Request for Substitution. At any time prior to the end of the Substitution Period, the Account Party may request the cancellation of any existing Letter(s) of Credit and the substitution therefor of one or more new Letters of Credit in accordance with this Clause 5.
Request for Substitution. A post-award request for substitution of an item or service must be submitted in writing to the Engineer for approval in advance, within the applicable time period provided in the Contract Documents. If no time period is specified, the substitution request may be submitted any time within 35 days after the date of award of the Contract, or sufficiently in advance of the time needed to avoid delay of the Work, whichever is earlier.
Request for Substitution. Borrower shall submit to Lender a written request for the Substitution not less than thirty (30) days prior to the proposed Substitution. Notwithstanding the preceding sentence, by executing and delivering this Agreement, Borrower requests a Substitution of the ADP Property on or after October 9, 2007 and Lender acknowledges that such request is deemed to satisfy the requirement of the preceding sentence. If any Substitution requested pursuant to this subsection shall fail to occur for any reason, Borrower shall be entitled to submit written requests until a Substitution shall actually occur.
