– Representation/Recognition. A. The Board hereby recognizes the Association as the exclusive bargaining representative as defined in Act 336 of the Michigan Public Acts of 1947, as amended, for all certified staff performing forty percent (40%) or more of school time as classroom teachers. This would include by way of illustration, but not by way of limitation, counselors, media specialists, psychiatrists, psychologists, social workers, librarians, speech therapists, hearing therapists, visiting teachers, advising or critic teachers, and teachers of the homebound or hospitalized. The positions above include personnel on tenure, probation and on per diem appointments who teach sixty (60) or more consecutive school days in the same assignment, but excludes supervisory and executive personnel engaged in direct administration and supervision of professional personnel. The term certified staff when used hereinafter in the Agreement, shall refer to all employees represented by the Association in the bargaining or negotiating unit as above defined.
B. The Board agrees not to negotiate with any teachers' organization other than the Association for the duration of the Agreement or until a representation election is held.
C. Nothing contained herein shall be construed to deny or restrict any teacher rights they may have under the Michigan General School Laws, Michigan Teacher Tenure Law, or any other applicable laws and regulations. The rights granted to certified staff hereunder shall be deemed to be in addition to those provided elsewhere. If any provision of this Agreement or any application of the Agreement to any employee or group of employees shall be found contrary to law, then such provision or application shall not be deemed valid and subsisting except to the extent permitted by law, but all other provisions or applications shall continue in full force and effect.
D. Both parties accept, as part of this agreement, the Teachers' Personnel Policies pertaining to wages, hours, terms and conditions of employment as amended as of the ratification of the Master Contract by the Board, with the understanding that any of the policies concerning wages, hours, terms and conditions of employment will be open for review and negotiations along with the Master Contract as provided for in Article XI of this agreement.
– Representation/Recognition. The District recognizes the Union as the sole and exclusive collective bargaining agent for all full-time and regular part-time classified employees of the Kalama School District, excluding supervisors, confidential employees, clerical employees, bus drivers and extracurricular employees and will deal with its representatives with respect to wages, hours, working conditions, and all other pertinent matters. The bargaining unit shall also include the classifications of ticket taker and facilities supervisor, provided that the only provisions of this Agreement which shall apply to such classifications are the wage rate in Appendix A and those sections which specifically identify those classifications.
– Representation/Recognition. The Employer recognizes the Union as the sole and exclusive collective bargaining agent for all classified employees of the Employer except for all secretarial and clerical employees and managerial and supervisory employees in the district.
