Renewal Notice; Notification of Changes. Subject to governing law, XOOM can renew this Agreement with new or revised Terms. No later than forty-five (45) days prior the end of the term, XOOM will send you renewal notices, at least two, describing additional service plans for your consideration, in the event XOOM elects to renew this Agreement. If you decide not to choose a new service plan upon the expiration of the term, this Agreement will automatically renew at a variable rate that will continue on a month-to-month basis, in accordance with the notices. XOOM reserves the right, with thirty (30) days’ notice, to amend this Agreement to adjust its service to accommodate any change in regulations, law, tariff, other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement, or to make other changes as XOOM sees fit. To the extent XOOM should amend for any reason other than a change in regulations, law, tariff or other change in procedure required by any third party that may affect XOOM’s ability to continue to serve you under this Agreement, you will have the right to cancel this Agreement by providing written notice to XOOM within thirty (30) days of the date of the notices. XOOM will not make material changes to your contract without your consent. Termination, Moving:You may cancel your acceptance of the Agreement with XOOM at any time within seven (7) business days following the postmark date on the utility’s confirmation notice without penalty or cancellation fee by calling or writing your local utility. When moving to an address within your local utility’s service territory, XOOM will make every effort to transfer your service to your new service address when you move to an address within your local utility’s service territory, provided that you notify XOOM within fifteen (15) days of your move. If transfer of service is not successful or you moved to a location outside your local utility’s service territory or within the service territory of your local utility that does not portability of the contract, you may cancel this Agreement at no cost to you. Failure to notify XOOM of your move will be considered a cancellation of this Agreement in accordance with its terms. This contract will automatically terminate if the requested service location is not served by your local utility, you move outside your local utility’s service area or to an area not served by XOOM, or XOOM returns you to your local utility’s sales service.

BILLING AND PAYMENT: Approximately each month your bill for electricity supplied by NAP, not including the Local Utility’s charges for transmitting and delivering the electricity over the Local Utility’s system, will be calculated by multiplying (i) the price of electricity by (ii) the amount of electricity used in the billing cycle, as measured by your Local Utility. You will still receive one monthly bill from your Local Utility, which will include charges for Supply Service provided by NAP. You will continue to pay your Local Utility directly on a month-to-month basisthe due date as set forth on the Local Utility’s bill. If you do not pay your bill(s), in accordance with NAP may terminate your electricity service Agreement under procedures approved by the notices. XOOM reserves the right, with thirty (30) days’ noticeME PUC, to amend this Agreement the extent permitted by applicable law. Thereafter, if you fail to adjust its service remit payment owed to accommodate NAP in a timely fashion, NAP may report the delinquency to a credit reporting agency. All returned checks will be subject to the maximum fee allowed by law. If NAP invoices you for any change unpaid NAP charges, you will pay each invoice in regulationsfull within 20 calendar days of the invoice date or be subject to a late payment charge of 1.5% per month. For invoices provided by NAP, law, tariff, other change in procedure required by any third party you acknowledge that may affect XOOMNAP’s ability to continue invoice you is dependent on the Local Utility furnishing to serve you under this AgreementNAP all necessary information to comply with ME PUC rules. Each invoice sent to you shall also be subject to adjustment for errors in arithmetic, computation, meter readings or other errors for a period of this Agreement in accordance with its terms. This contract will automatically terminate if time for which the requested service location error is not served by your local utility, you move outside your local utility’s service area or to an area not served by XOOMbeing re-billed, or XOOM returns for a period of 3 months following such time the Local Utility may be permitted under law to make such an adjustment, whichever is longer. NAP will pass through to you all reasonable charges related to your local utility’s sales servicethe collection of past due invoices, including, but not limited to, collection agency fees, legal and court fees, and account termination fees.
