Common use of Removal and Making Good of Non-Compliant Work Clause in Contracts

Removal and Making Good of Non-Compliant Work. The Design-Builder shall remove from the Site within the space of time designated in Notice of Non-Compliant Work all work determined by the Design Builder (or Program Manager under Paragraph 3.6.2.2 above) as failing to conform to the contract, whether incorporated in the work or not, and the Design-Builder shall promptly replace and re-execute the work in accordance with the Contract and without expense to the Owner and shall bear the expense of making good all work of other contractors destroyed by such removal or replacement. The Design-Builder shall supply any omitted work and perform all unexecuted work within the space of time fixed in Notices of Non-Compliant Work.
