The government enters into this Agreement based on the individual facts and circumstances presented by this case, including the nature and seriousness of the offense conduct, ComEd’s timely notification to the government of an internal investigation after receiving a subpoena and being notified by the government of the nature of the government’s investigation, ComEd’s ongoing cooperation described more fully below, and its remedial measures and operational improvements also described more fully below.
