Refuse Transfer. To refuse, in ▇▇▇▇▇▇▇▇’s reasonable discretion (taking into account all relevant factors, including the factors set forth below), to approve the Transfer and to continue this Lease in full force and effect as to the entire Premises. If Landlord fails to notify Tenant in writing of such election within the 10-Business Day period, Tenant shall have the right to send an additional notice to Landlord requesting Landlord’s consent to the Transfer, which notice shall contain in bold and capital letters at the top of the first page language stating that “PURSUANT TO SECTION 26(C) OF THE LEASE, FAILURE TO RESPOND TO THIS LETTER MAY RESULT IN DEEMED APPROVAL OF A TRANSFER OF THIS LEASE”, and if Landlord still fails to respond to ▇▇▇▇▇▇’s request within 5 days thereafter, then Landlord will be deemed to have elected to approve such Transfer.
