References to and Effect on the Credit Agreement. (a) On and after the Thirteenth Amendment Effective Date each reference in the Credit Agreement to “this Agreement,” “hereunder,” “hereof,” “herein,” or words of like import, and each reference to the “Credit Agreement,” “thereunder,” “thereof,” “therein,” or words of like import in respect of the Credit Agreement, as the case may be, in the Loan Documents and all other documents (the “Ancillary Documents”) delivered in connection with the Credit Agreement shall mean and be a reference to the Credit Agreement as hereby amended.

References to and Effect on the Credit Agreement. (a) On and after the Thirteenth Eighth Amendment Effective Date each reference in the Credit Agreement to “this Agreement,” “hereunder,” “hereof,” “herein,” or words of like import, and each reference to the “Credit Agreement,” “thereunder,” “thereof,” “therein,” or words of like import in respect of the Credit Agreement, as the case may be, in the Loan Documents and all other documents (the “Ancillary Documents”) delivered in connection with the Credit Agreement shall mean and be a reference to the Credit Agreement as hereby amended.

References to and Effect on the Credit Agreement. (a) On From and after the Thirteenth Amendment Effective Date each reference in effectiveness of such amendment, the Credit Agreement to terms “Agreement”, “this Agreement,” ”, “hereunder,” herein”, “hereinafter”, “hereto”, “hereof,” “herein,” or and words of like similar import, and each reference to the “Credit Agreement,” “thereunder,” “thereof,” “therein,” or words of like import as used in respect of the Credit Agreement, shall, unless the context otherwise requires, refer to the Credit Agreement, and the term “Credit Agreement”, as the case may be, used in the other Loan Documents and all other documents (the “Ancillary Documents”) delivered in connection with the Credit Agreement , shall mean and be a reference to the Credit Agreement as amended hereby and as may be further amended, supplemented or otherwise modified from time to time. This Fifth Amendment shall constitute a “Loan Document” under the Credit Agreement.

References to and Effect on the Credit Agreement. (ai) On and after the Thirteenth Eleventh Amendment Effective Date each reference in the Credit Agreement to “this Agreement,” “hereunder,” “hereof,” “herein,” or words of like import, and each reference to the “Credit Agreement,” “thereunder,” “thereof,” “therein,” or words of like import in respect of the Credit Agreement, as the case may be, in the Loan Documents and all other documents (the “Ancillary Documents”) delivered in connection with the Credit Agreement shall mean and be a reference to the Amended Credit Agreement as hereby amendedAgreement.

(a) On and after the Thirteenth Amendment Effective Date date hereof, each reference in the Credit Agreement to “this Agreement,” agreement”, “hereunder,” ”, “hereof,” ”, “herein,” or words of like import”, and each reference to the “Credit Agreement,” “thereunder,” “thereof,” “therein,” or words of like import in respect of the Credit Agreement, as the case may be, in the Loan Documents and all other documents (the “Ancillary Documents”) delivered in connection with the Credit Agreement shall mean and be a reference to the Credit Agreement as hereby amendedamended hereby; and each reference to “the Line of Credit Note,” shall mean and be references to the Second Amended and Restated Note as set forth in Section 1.05(b) herein.

This Seventh Amendment shall constitute a “Loan Document” under the Credit Agreement.

(a) On and after the Thirteenth Tenth Amendment Effective Funding Date each reference in the Credit Agreement to “this Agreement,” “hereunder,” “hereof,” “herein,” or words of like import, and each reference to the “Credit Agreement,” “thereunder,” “thereof,” “therein,” or words of like import in respect of the Credit Agreement, as the case may be, in the Loan Documents and all other documents (the “Ancillary Documents”) delivered in connection with the Credit Agreement shall mean and be a reference to the Credit Agreement as hereby amended.
