Common use of Recovery of Money Clause in Contracts

Recovery of Money. Whenever, under the Contract, any sum of money shall be recoverable from or payable by the Professional to the Owner, the same amount may be deducted from any sum due to the Professional under the Contract or under any other Contract between the Professional and the Owner. The rights of the Owner are in addition and without prejudice to any other right the may have to claim the amount of any loss or damage suffered by the Owner on account of the acts or omissions of the Professional.
