RECOGNITION PROCEDURE. The Board, in order to recognize a teacher organization as the exclusive representative of teaching personnel requires satisfactory evidence that the organization in fact represents a majority of such employees. Such evidence shall be in the form of dues deduction authorizations. In the event of a challenge, the Board will proceed according to the regulations of the Public Employee Relations Board established under Article 14 of the Civil Service Law. By virtue of satisfactory evidence submitted by the Association to the Board that the Association does represent the majority of the professional employees in the District, the Board hereby recognizes the Association as the exclusive official negotiating agent for all instructional and teaching personnel under contract, excluding personnel employed by the Board of Cooperative Educational Services. The term "Teacher" means classroom teachers, teaching assistants, librarians, Guidance Counselors, those substitutes hired for a semester or more as replacements for teachers on leave, Nurses, and Coordinators. The Association shall submit to the Board by October 15 of each year a list of all new dues deduction authorizations of the active members of the Association. This recognition shall continue in effect so long as the Association's active membership contains more than fifty (50) percent of the total employees in the negotiating unit, until the termination date of October 15 of each contract year.
