RECOGNITION (continued). a. The damages have not resulted from the negligence, misfeasance, or malfeasance of the Board or its agents. b. The Association, after consultation with the Board, has the right to decide whether to defend any said action or whether or not to appeal the decision of any court or other tribunal regarding the validity of the article or the defense, which may be assessed against the Board by any court or tribunal. c. The Association shall notify the Board of the Association's attorney, and the Association's attorney shall consult with the Board's attorney as to all phases of the suit or action. d. The Association shall have the right to compromise or settle any claim made against the Board under this article.
