Common use of Random Tests Clause in Contracts

Random Tests. 1. All workers in covered positions are subject to unannounced drug and alcohol testing based on random selection. 2. Tests for alcohol shall be conducted just before, during or just after the performance of safety-sensitive functions. 3. The number of random alcohol tests annually must equal 25% and the number of random drug tests annually must equal 50% of the annual average number of covered positions, including substitutes, full-time, part-time and temporary workers. 4. A scientifically valid random process shall be used, and each worker shall have an equal chance of being tested each time selections are made.
