Common use of Quantity Clause in Contracts

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 155% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 155 % more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods Products of up to 1525% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods Products or any portion of them by reason of the surplus or shortfall and shall pay for such Goods Products the price set forth in the Sales Confirmation adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 1590% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

(a) If Seller delivers to Buyer a quantity of Goods of up to 155% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

If Seller delivers to Buyer a quantity of Goods of up to 1525% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If the Seller delivers to Buyer a quantity of Goods Product of up to 15% twenty percent (20%) more or less than the confirmed order quantity set forth in the Sales Confirmationpounds, Buyer shall not be entitled to object to or reject the Goods Product or any portion of them by reason of the surplus or shortfall and shall pay for such Goods Product at the price set forth in the Sales Confirmation adjusted pro rataagreed upon price.

Quantity. If Seller XXXX delivers to Buyer a quantity of Goods of up to 155% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% more or fifty percent (50%) less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 1520% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of delivery due to the surplus or shortfall and shall pay for such Goods at the price set forth in the Sales Confirmation adjusted pro rata. Seller shall have no right to reject quantities in excess.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 15% five percent (5%) more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.

Quantity. If Seller delivers to Buyer a quantity of Goods of up to 1510% more or less than the quantity set forth in the Sales Confirmation, Buyer shall not be entitled to object to or reject the Goods or any portion of them by reason of the surplus or shortfall and shall pay for such Goods the price set forth in the Sales Confirmation adjusted pro rata.
