Qualifying for Payment. Settlement Class members shall be entitled to submit a claim for a monetary payment if their name is on the Notice Database or Class List as a person whose cell phone was called by Xxxxx Fargo by an autodialer and / or a prerecorded voice message during the Class Period.
Qualifying for Payment. Settlement Class Members who submit a completed Claim Form to the Settlement Administrator on or before the Claims Deadline shall qualify for payment. Class Counsel, Defendants and ClearLight shall have the right to monitor and audit Claim Forms submitted by any person or entity, and if Class Counsel, Defendants or ClearLight believe that any Claim Form submitted is not valid or that the person submitting the Claim Form is not a Settlement Class Member or is otherwise not entitled to payment, Class Counsel, Defendants and ClearLight shall confer in good faith. If they agree payment should not be made to the person or entity in question, the Settlement Administrator shall notify that person or entity. If they do not agree with regard to whether payment should be made or if the person or entity whose Claim Form was disallowed does not agree with the determination of the Parties, all such disputes shall be referred to the Court for resolution.

Qualifying for Payment. Settlement Class Members shall qualify for payment from the Settlement Fund if they submit an Approved Claim and the cellular phone number they submit on their Claim Form is on the Text Message List as a phone number that was sent a text message during the Class Period by or on behalf of Bluestem and where the number was coded by Bluestem as a “wrong party” on an outbound call. Only one claim for each cellular phone number that received an allegedly offending text shall be permitted unless the Claims Administrator determines that multiple claimants were the subscriber or primary user of the same cellular phone number during different time frames within the Class Period, in which case each such individual will be eligible to qualify for a payment from the Settlement Fund.
